"When it comes to charitable giving, America is a world-beater.   According to Giving USA, an annual compendium of national data on philanthropy, Americans last year donated more than $316G to charity, or roughly 2% of GDP.   Contrary to popular belief, most of that money didn't come from foundations or corporations.   It came from individuals.   In 2012, donations from private American households added up to about $223G.   Whether measured per capita or as a share of national wealth, charity in other countries doesn't come close.   The extraordinary generosity of ordinary Americans has often been noted.   Arthur Brooks, the president of the American Enterprise Institute, calls it the nation's most salient feature.   'The truly extraordinary thing about the United States is not how much we produce -- nor how much we consume.', Brooks wrote in _Who Really Cares_...   Seen as a whole, Americans are indeed charitable standouts.   Not even Canada, so similar to the United States geographically and culturally, shows the same commitment to charity.   'Private monetary generosity in Canada is considerably lower than in the United States.', noted the Fraser Institute, a leading Canadian think tank, in a report last December (pdf).   'This generosity gap undoubtedly limits the ability of charities to improve the quality of life in Canada.'   But not all Americans donate.   There are notable gaps here too.   As you'd expect in a country where so many dollars go to charity, there is no shortage of data on where those dollars come from, and what kind of Americans are likeliest to give them.   In a recent essay in Philanthropy magazine (the quarterly journal of the Philanthropy Roundtable), Karl Zinsmeister usefully surveys the scholarly research..."

"Its chief interest is in expanding the H-1B work visa program for [allegedly] 'highly skilled' workers [but in reality a bell-curve of STEM professionals with low, middling and high skill levels] that's mostly used by tech employers to hire temporary guest-workers from foreign countries, usually from East and South Asia.   Valley executives have been calling for decades for H-1B expansion (the current cap is 65K visas annually, although thanks to loop-holes [exemptions] and related programs, it's actually [more than] double that).   During the 1990s the argument was that native-born U.S. programmers were set-in-their-ways oldsters (translation: men and women in their 40s) whose brain cells couldn't make the transition from, say, COBOL to more up-to-date coding languages.   The new argument is that tech workers are in dangerously short supply, especially 'the best, brightest, and hardest workers', as New York City mayor Michael Bloomberg, an H-1B expansion advocate, testified before Congress in February [though even many of those over 35 who are adept in a dozen programming languages, a dozen operating systems, and several software and data-base design and development methodologies have been side-lined].   FWD.us certainly has allies in the bay area's substantial Indian community.   At a gym in Fremont, a middle-income suburb directly across the bay from East Palo Alto that counts 40K Indians among its 222K residents, I interviewed 38-year-old Nikesh Kalra, Santa Clara-born of Indian immigrant parents, who, with an MBA from Oxford, is an executive for Equinix, a cloud-storage landlord headquartered in Redwood City.   'The perception is that Indians are taking away good American jobs.', Kalma said.   'The reality is that you Americans can't turn out engineers fast enough.'   The anti-H-1B faction has a response to that: statistics.   One of them, from an April 24 briefing paper produced by the liberal Economic Policy Institute, is that only one out of every two U.S. college graduates with a degree in engineering or computer and information science is hired into those fields, despite a doubling of the number of homegrown computer-science graduates between 1998 and 2004.   Others argue that employers mostly don't use H-1B workers to fill [allegdly] 'best and brightest' jobs, but, rather, relatively low-paying routine programming positions, and that the most avid users of the visas are India-based outsourcing companies that use the visas to provide a few months of U.S. training for their employees, who then return to India.   Most damning of all is that, despite persistent claims of tech-worker shortages, programmer salaries overall have inched only slightly higher from what they were 20 years ago: from $60K a year to about $75K a year in 2012 dollars, according to the Economic Policy Institute.   [Employed] Engineers fare somewhat better: The average annual starting salary at top valley employers such as Google is about $100K, with the median for experienced engineers at about $150K.   Even with the stock options many employers offer, that doesn't go far toward buying even the smallest million-dollar valley house.   A group of software engineers has a pending law-suit alleging that 4 of the biggest employers -- Apple, Google, Intel, and Adobe Systems in San Jose—violated federal anti-trust laws between 2005 and 2009 by agreeing not to 'poach' each other's employees with offers of higher pay.   On top of those perhaps deliberately depressed salaries and the high cost of existing housing are a raft of California 'green' laws—enthusiastically supported, as one might expect, by the valley's tech elite in a post-manufacturing economy—that make life there even more expensive, and family-friendly housing even less attainable.   Renewable-energy mandates drive up utility costs, and environmentally driven land-use restrictions and 'smart growth' plans have made the construction of new single-family homes in the valley all but impossible for everyone except those affluent enough to own a large-lot tear-down...   'For each new software designer hired at Twitter in San Francisco, there are 5 new job openings for baristas, personal trainers, therapists and taxi drivers.'"

"According to a new study by the Labor Center at the University of California Berkeley, more than a third of the nation's 500K bank tellers are being partially supported by taxpayers.   That is despite the fact that bank profits exceeded $141G last year and the median income for the industry's chief executives was a tidy $550M plus.   Match that against data from the Bureau of Labor Statistics that puts the median annual income of a bank teller $24,100.   That's a whopping $11.59 cents an hour, hardly enough to live on without a second job or (and here's the rub) help from tax-supported programs like food stamps and Medicaid.   The report says that in New York State alone 39 percent of the bank tellers and their family members are on some sort of public assistance.   Bank employees nationwide receive $534M from Medicaid and the Children's Health Insurance Program; $105M worth of food stamps and $250M for the earned income tax credit.   That's nearly $900M a year in supplemental income."

About 5.5M individuals looked for a job but did not work at all in 2012, down from 6.2M in 2011.
 
The proportion of men who worked during 2012 was 69.5%, up from 68.8% in 2011.   The proportion of women who worked at some point during 2012 was 58.4%, little changed from 2011.
 
The proportions of whites (64.5%), blacks (59.1%), Asians (64.5%), and Hispanics (64.3%) who worked at some time during 2012 increased from 2011.

Of the total who worked during 2012, 76.7% were employed year round (working 50 to 52 weeks, either full or part time), little changed from 2011.   The percentage of women working year round decreased by 0.8 percentage point to 74.7% in 2012, while the percentage of men employed year round was little changed at 78.5%.
 
Overall, 161.7M persons worked or looked for work at some time in 2012.   Of those, 22.4M experienced some unemployment during the year, 1.3M fewer than in 2011.   Men accounted for a disproportionately large share of the over-the-year decline in those who experienced some unemployment.
 
At 13.9% in 2012, the work-experience unemployment rate (those looking for work during the year as a percent of those who worked or looked for work during the year) was 1.0 percentage point lower than in 2011.   The work-experience unemployment rates for whites (12.8%) and blacks (20.6%) declined from 2011 to 2012, while the rates for Asians (10.6%) and Hispanics (17.3%) changed little.
 
Overall, men continued to have higher work-experience unemployment rates in 2012 than women, 14.5% versus 13.1%.   Among whites, blacks, and Hispanics, the rates for men were higher than the rates for women.   Among Asians, the rates for men and women were little different from each other.
 
Among those who experienced unemployment in 2012, the median number of weeks spent looking for work fell to 18.4, following 3 years of little movement.   The number of persons who looked for a job but did not work at all in 2012 declined by 701K over the year to 5.5M.   Of the 16.9M individuals who worked during 2012 and also experienced unemployment, 22.2% had 2 or more spells of joblessness, up from 20.1% in 2011."

"Back in 2011, when Paul Ryan's name was floated as a possible Republican presidential candidate we said, 'Not so fast, Paul' and pointed out that his much ballyhooed 'Path to Prosperity' budget plan allowed spending to rise to $4T over the next 5 years.   Even worse in the minds of fiscal conservatives and limited government constitutional conservatives, Ryan's proposal reduced deficits, but it did not eliminate them until 2040, 27 years from now, according to the CBO analysis.   The 'Path to Prosperity' document included projections for the public debt between 2011 and 2021, and it showed debt going up every single year.   Ryan's budget showed the debt increasing to $16.2T in 2012 (we've already blown past that) and rising every year after that up to $23.1T in 2021 -- and the latest projections show it rising even faster than those made back in 2011.   Despite Ryan's command of the budget numbers he seems incapable of grasping -- or more likely simply ignored – the basic law of Washington spending and politics: for every dollar of revenue raised spending inevitably goes up more than a dollar.   Back in the late 1980s, Richard Vedder, and Lowell Gallaway of Ohio University co-authored a study for Congress' joint Economic committee that found that every dollar of new taxes imposed led to more than one dollar of new spending.   Over the ensuing years that study has been updated and the results are always the same.   In 2010 November, Vedder and The Wall Street Journal's Stephen Moore released an updated and more sophisticated version of the study showing that 'over the entire post World War II era through 2009 each dollar of new tax revenue was associated with $1.17 of new spending.   Politicians spend the money as fast as it comes in -- and a little bit more.'   What Moore and Vedder found was that no matter how you controlled for the economic variables, spending always went up faster than revenue.   The alternative models produce different estimates of the tax-spend relationship -- between $1.05 and $1.81.   But no matter how they configured the data and no matter what variables they examined, higher tax collections never resulted in less spending..."

"There will be a farm bill this year, but it's not clear whether that bill will be some sort of extension of the existing bill or a new bill, said Karl Zulauf, agricultural economist for Ohio State University.   The current farm bill has been extended through the end of January...   Both the Senate and the House have passed farm bills this year, but they differ on how much to cut the nation's food-stamp program and how to restructure farm subsidies.   The bill is expected to have additional cuts to the food-stamp and nutrition programs and expansion of crop-insurance alternatives.   Neither party is providing much detail about specifics of what the bill contains...   Another piece of legislation that will impact farmers is the expiration in 2014 of the depreciation credit for the purchase of agricultural equipment, said David Marrison, extension agent for Trumbull and Ashtabula counties.   For this year, the credit is for equipment purchases of up to $500K, he said.   A bill has been introduced in the U.S. senate that would make permanent a depreciation credit of up to $1M per year, Marrison said.   It is unclear whether the legislation will move forward.   'There are also some weird things in this bill; for example, with tiling you would be able to write off 44% of the cost in the first 15 years, but it would take 144 years to write of the full cost.', he said.   Tile doesn't last 144 years, and keeping up the consistent replacement of the material could get confusing, Marrison said.   The bill as proposed also would remove the 15% depreciation tax credit, he said."
Wouldn't that be sweet, for software engineers, analysts, web-weavers, data-base designers to be able to deduct $3K-$4K for the costs of replacing hardware and software tools every couple years.   But that would be no help at all to the millions of STEM pros unemployed or involuntarily out of field...jgo

"Over the years I have had many people ask me what I would like to see done on the immigration issue.   1.   Enforce our immigration laws.   They haven't been enforced for the last 25 years or more.   2.   Secure our borders.   3.   Stop illegal immigration.   Remember, illegal aliens come from every country on the planet.   All illegal aliens should be deported.   Tell them they have 60 days to leave on their own or we will round them up and send them back home at their expense.   This would be the cheapest in the long run.   The government says there are 11M, but they've been saying that for about 12 years.   According to other sources, it is 20M to 25M.   It would free up about 8M jobs.   We don't need these law breakers.   If we took away all the freebies they get, most of them would self deport.   From 1928-1965 we let in about 178K legal immigrants per year.   Now it is up to more than 1M per year.   We don't need all these people, and our resources are finite.   Let's not import poverty.   Let's let in people who have the talents to make the U.S.A. a better country, not people who drag us down.   Limit immigrants to 200K per year."

"The advance number of actual initial claims under state programs, unadjusted, totaled 414,002 in the week ending December 14, a decrease of 48,196 from the previous week.   There were 401,429 initial claims in the comparable week in 2012.   The advance unadjusted insured unemployment rate was 2.2% during the week ending December 7, a decrease of 0.1 percentage point from the prior week.   The advance unadjusted number for persons claiming UI benefits in state programs totaled 2,878,730, a decrease of 81,111 from the preceding week.   A year earlier, the rate was 2.5% and the volume was 3,244,564.   The total number of people claiming benefits in all programs for the week ending November 30 was 4,412,144, an increase of 606,051 from the previous week.   There were 5,402,429 persons claiming benefits in all programs in the comparable week in 2012.   No state was triggered 'on' the Extended Benefits program during the week ending November 30...   States reported 1,374,031 persons claiming Emergency Unemployment Compensation (EUC) benefits for the week ending November 30, an increase of 125,099 from the prior week.   There were 2,096,545 persons claiming EUC in the comparable week in 2012.   EUC weekly claims include first, second, third, and fourth tier activity.   [Note that the population used for calculating the "insured unemployment rate" (the divisor) changes roughly quarterly:

"John Boehner is the Speaker of the House of the United States of America and the leader of one of America’s two major political parties.   Is he the best and brightest we have to offer? Are you kidding me?   No wonder the GOP Congress loses at every turn to Barack Obama.   We are led by a fool.   Boehner is the worst negotiator I’ve ever seen.   He fights with a white flag.   Total surrender.   He fights like a man pre-ordained to lose, his every move dominated by fear and an inferiority complex.   [Or like someone who wants to lose.]   This is our “leader?   Or is it all just a big choreographed game, like professional wrestling?   Are Obama and Boehner actually on the same team, fighting for the same goal: big government?   Do they only put on a show from time to time to keep everyone fooled into thinking there are really two different political parties to choose from?   Or perhaps Obama is using the National Security Agency [NSA] and the Internal Revenue Service [IRS] to black-mail GOP politicians?   Perhaps Obama has photos of Boehner in bed with the wrong person.   Because the way Boehner fights these battles is so embarrassing, I'd have more respect for him if he were being black-mailed.   That would explain his pathetic strategy, loser mentality and nonstop surrenders.   But now Boehner has gone and done the unthinkable.   This time he’s done something so stupid, it tops everything that came before.   Boehner just picked a fight with the Tea Party.   He just attacked his own political base.   His best customers.   His true-blue conservative army.   That's touching the third rail of politics.   That's a fatal mistake.   That's called “career suicide.   Going to war with your own base is unforgivable.   I learned from the best.   My grand-father came to America in the early 1900s with nothing.   Zero.   Just a dream.   He worked for 20 years as a butcher until he saved up enough money to open his own butcher store.   That small store became a huge success for more than 40 years.   My grand-father became a relatively wealthy man (for a small businessman with a tiny store) and a respected business leader in his community and, of course, a huge fiscal conservative.   Later in life, I asked him what was the key to his remarkable success, going from penniless foreigner to self-made millionaire with only a small butcher store.   He told me it was always about the customer.   He said, “There are 2 rules in business, my grand-son.   Rule #1 is: The customer is always right.   Rule #2 is: If the customer is wrong, refer back to Rule #1.   That's it.   Always protect your base.   Treat your base — your most loyal customers, your true believers — as kings.   And if they are wrong, treat them as if they are right.   Why? Because without your best customers, you are out of business.   You are up a creek without a paddle.   Your success, riches and power derive from that base.   Your job, above all others, is to nourish and protect that base.   Forget all the bad negotiating; Boehner has now violated the most important rule in business or politics.   As pathetic as he is at negotiating, he was always forgiven.   But this last act of madness cannot be forgiven.   He has bitten the hand that feeds him.   He turned on, attacked and denigrated the true-blue heroes of the Republican Party.   He attacked the people who keep the GOP in business.   Without the true-blue conservatives, you don’t have a business — or, in this case, a political party.   You have nothing.   Without our support, our energy, our enthusiasm, our hard work in the trenches and our donations, you have nothing.   The GOP -- like any business or political party -- ceases to exist without its best customers.   Boehner lost sight of the rules of battle.   A business is in business only because of its best customers.   Take them away, and the richest business owner is the owner of nothing.   Just as an army exists only because of its soldiers; demoralize them, and they become a defeated army.   The greatest general is left with nothing.   In Japan, that general would commit hari-kari.   In America, his life is spared; but he is relieved of command and retired.   A political party is a political party only because of its base.   Without its most loyal supporters and true believers, it is extinct.   And the leader of that baseless, rudderless party — no matter how powerful, no matter how delusional — is a leader of nothing.   Boehner chose to attack that base.   And for that sin, Boehner can never be forgiven.   For the sake of the GOP and the future of [the United States of America], Boehner must go."

"For years, I used to blame politicians for our economic and social mess.   That changed during the 1980s as a result of several lunches with senator Jesse Helms, R-NC, which produced an epiphany of sorts.   At the time, I had written several columns highly critical of farm subsidies and hand-outs.   Helms agreed, saying something should be done.   Then he asked me whether I could tell him how he could vote against them and remain a senator from North Carolina.   He said that if he voted against them, North Carolinians would vote him out of office and replace him with somebody probably worse.   My epiphany came when I asked myself whether it was reasonable to expect a politician to commit what he considered to be political suicide -- in a word, be 'dumb'.   The Office of Management and Budget calculates that more than 40% of federal spending is for entitlements for the elderly in the forms of [Socialist Insecurity], Medicare, Medicaid, housing and other assistance programs.   Total entitlement spending comes to about 62% of federal spending...   In 1794, James Madison, the father of our Constitution, irate over a $15K congressional appropriation to assist some French refugees, said, 'I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents.'   He added, 'Charity is no part of the legislative duty of the government.'   In 1854, President Franklin Pierce vetoed a bill intended to help the mentally ill, saying, 'I cannot find any authority in the Constitution for public charity [and to approve such spending] would be contrary to the letter and the spirit of the Constitution and subversive to the whole theory upon which the Union of these States is founded.'   Grover Cleveland vetoed hundreds of congressional spending bills during his 2 terms as president in the late 1800s.   His often-stated veto message was, 'I can find no warrant for such an appropriation in the Constitution.'"

Haven in South Texas wrote on Dec. 13 that the Department of Homeland Security (DHS) was 'completing the criminal mission of individuals who are violating the border security of the United States'.   The case involved a smuggler who was caught at the border with a 10-year-old girl from El Salvador.   An illegal alien had paid the child trafficker to bring her daughter to her in Virginia.   While the smuggler was arrested, Homeland Security agents took the child to her mother, but they were neither arrested nor deported.   Judge Hanen wrote that this was the fourth case of its type he had heard recently in which 'DHS completed the criminal conspiracy' and 'simply chosen not to enforce the United States' border-security laws'."

Albright and James Baker have given speeches at the Guelen Institute...in Houston...   the Turquoise Council of Americans and Eurasians, has paid for 10 trips for members of Congress to Turkey and Azerbaijan.   The group's president, Kemal Oksuz, is the former executive director of the Niagara Foundation in Chicago, whose honorary president is Gulen.   In the same period, at least four other members of Congress made trips to Turkey sponsored by Gulen-associated groups.   'It's important to introduce people to our Muslim society and to introduce them to their counterparts in Turkey.', Celik said...   In 2012, the Texas state education agency found Harmony, the largest charter operator in the state, failed to properly document its use of $186K in federal funds, or about one-third of the dollars auditors examined for the fiscal year ending 2010 August.   Harmony re-paid the money, according to the state, but school officials maintained they did nothing wrong.   Harmony schools have also drawn scrutiny for their reliance on visas to bring Turkish staff to the United States.   A spokes-woman said fewer than 10% of Harmony's 2,617 employees hold H-1B visas.   In Philadelphia, an English teacher at a Gulen-linked Truebright Science Academy Charter School sued the school this year, claiming that it had hired and promoted less-qualified Turkish nationals and paid them more than U.S.-born educators who were certified and more experienced.   The civil rights complaint was settled for an undisclosed amount.   In Chicago, a Gulen-connected school, Concept Schools Inc., lost a bid last year to open two new schools.   Concept Schools appealed to the state charter school commission, which was created in 2011 by law-makers including Illinois House Speaker Michael Madigan.   Madigan had visited Turkey 4 times in the past 4 years at the expense of the Niagara Foundation and the Chicago Turkish American Chamber of Commerce, according to disclosure reports.   The state commission reversed the earlier decision and gave the green light to Concept Schools to open 2 new schools..."

"According to the federal government office that compiles and publishes immigration statistics, the [Obummer regime] actually has the lowest number of deportations, and lowest average annual number of deportations since the Nixon administration...   There we find that in its first four years, the [Obummer regime] deported 3.2M aliens, averaging just about 800K per year.   Official numbers for 2013 have not been released yet, but indications are that the total will be about the same.   These numbers include all deportations done by all DHS officers at the border, at the ports of entry and from the interior of the country.   That is nowhere near the numbers of the George W. "The children, ages 2.5 to 3, wore activity monitors on their wrists to detect when they slept.   Parents kept diaries about bedtime routines.   Then on the last afternoon, researchers visited each home, dimming lights and covering windows.   Then, every 30 minutes for 6 hours leading up to the child's appointed bed-time, they also coaxed each tot to chew on some dental cotton to provide a sample of saliva.   The reason: To test for levels of a hormone named melatonin that is key to the sleep cycle and also sensitive to light.   At some point every evening, people's melatonin levels surge and a while later, they begin to feel sleepy.   Among adults who sleep well, that melatonin rise tends to happen about 2 hours before whatever is their chosen bedtime.   For pre-schoolers, the new study found that on average, the melatonin surge occurred around 19:40.   The children tended to be tucked in around 20:10, and most were asleep 30 minutes later, LeBourgeois reported in the journal Mind, Brain and Education.   When melatonin rose earlier in the evening, tots who hit the sack around 8 fell asleep a bit faster.   But when the melatonin surge was closer to bed-time, the youngsters were more likely to fuss or make curtain calls after lights-out...   Research shows that in adults, too much light in the evening delays the melatonin surge and subsequent sleepiness.   While there's no data in young children yet, LeBourgeois says dimming the lights about an hour before bedtime makes sense.   Avoid electronics near bedtime, because they generate a specific type of light that triggers wakefulness.   LeBourgeois was horrified to hear one parent offer a sleepless youngster an iPad to play with as long as the child stayed in the bed-room.   And make sure blackout shades aren't keeping your children from getting enough morning sunlight, she said.   Light in the morning also is key to keeping the biological sleep clock on schedule."

And it is not as though Diana Furchtgott-Roth doesn't know better.   She's seen the statistics, or at least been sent them.   But they don't fit her agenda, so she ignores or buries them to promote her agenda (though as a fellow advocate of capitalism, honest money, and markets free of initiated force and fraud her underlying reasoning on which that agenda is based is a mystery).
 
The 30M jobs dearth is based on historical BLS employment/population figures, which have dropped severely for men and blacks.
 
BLS data also confirm that unemployment rates in STEM occupations have been running 2 to 3 times as bad as during periods of full employment for these fields (particular those related to software product development and systems administration).
 
Dozens of professorial researchers associated with over 15 universities and several think tanks and government research groups over the last several decades have confirmed a sufficiency of STEM professionals.
 
In the last 10-15 years, B. Lindsay Lowell, Hal Salzman, Michael Teitelbaum, Daniel Kuehn, Hamutal Bernstein, Everett Henderson and others, through at least 5 studies, have found that the USA has been producing 2 to 3 times as many degreed US citizen STEM pros as have been hired to do STEM work.
 
Steven Camarota of the Center for Immigration Studies, based on BLS figures at the beginning of 2012, reported that over 1.8M US citizen STEM pros were involuntarily out of field or unemployed at that time, and the situation has only continued to worsen since then.
 
According to the US State Dept. annual reports, the last time fewer than 85K new/initial H1-B visas were issued was 1997.  
In fiscal year 1998, 91,360 new/initial H-1B visas were issued through consular offices (and additional new grants of H-1B status were given through other processes), while hundreds of thousands of able and willing US citizen STEM professionals were unemployed.  
In FY2010, the federal government issued over 117,828 new/initial H-1B visas.
In FY2011, they issued over 129,552 new/initial H-1B visas.
In FY2012, they issued over 135,991 new/initial H-1B visas.
These, of course, do not count the renewals and extensions, and yet they are at least 100 times what would be reasonable if we were actually using the H-1B visa to bring in people who were "best" or "brightest" with knowledge and skills rare in the USA.
 
USCIS reported approved renewal and extension applications for H-1B visas 161,367 in FY2006, 161,413 in FY2007, 166,917 in FY2008, 127,971 in FY2009, 116,363 in FY2010, 163,208 in FY2011, and 125,679 in FY2012.   These are, once again, at least 2 orders of magnitude excessive given the US job market indicators, degrees earned by US citizens, autodidactic expertise in the affected fields among US citizens, etc.
 
No one knows how many people are present in the USA at any particular time on any one particular kind of visa, a few pilot projects aimed at accomplishing that were quickly abandoned as hopelessly inaccurate, but estimates for people in the USA on valid H-1B visas have been running between 500K and 600K.
 
Yes, there is a USCIS "limit" on H-1B visas of 65K per year, and another allotment of 20K per year on top of that, and an unlimited number of exemptions, not based on individual merit, intelligence, productivity, etc., but simply by employer...   which exemption displaces a lot of able and willing US citizen students and grads.
 
Did dear Felicity or the Tsarnaev brothers undergo, pay for and pass a proper background investigation to see whether they are likely to be in the habit of or have the intention to initiate force or fraud in the USA?   No, not a check, not a data-base look-up, but an actual investigation.   The answer to that rhetorical question is "no"; despite all of the privacy violations imposed since 2001-09-11, the federal government still refuses to actually investigate visa applicants.   They're still waffling over whether visa applicants should even be interviewed.
 
There are no "high-skill visas".   There are no requirements that individual visa applicants be highly-skilled.   There are visa categories for various general categories of jobs.   Every category includes highly-skilled practitioners and low-skilled practitioners.   There are highly-skilled particle physicists and low-skilled particle physicists, highly-skilled software architects and low-skilled programmers, highly-skilled car mechanics and low-skilled car mechanics, highly-skilled janitors and low-skilled janitors.
 
I agree with Gary Becker's auction notion.   After the numbers of visas are reduced from the vastly excessive levels of the last century, after the bidders have paid for and passed their background investigations, after the applicants have passed their skill-level tests, a proportion of the annual quota of visas should be auctioned off monthly or weekly, to the highest bidders.   In line with Becker those bid amounts should align with the costs of processing the applications and with the compensation premium an economist would expect for those with skills in the top percentiles, not with the mean or median, and the below mediocre shouldn't even be considered.
 
Yes, the USA has plenty of product design engineers who have been being wasted doing testing, their time and lives wasted as MSFT e-mail administrators, or data-base maintainers.   We could always use a few more geniuses, a few more extremely knock-em-dead brilliant people.
 
Yes, many US multi-nationals have been creating more new jobs outside the USA than inside the USA since at least the 1980s.   The US government -- by visa and tax policies, and for the sake of international agreements -- has been encouraging the waste of US talent, encouraging more bodyshopping within the USA, encouraging more cross-border bodyshopping, and the bodyshopping has been encouraging more off-shoring via transfer of intellectual property and methods from the USA to other countries.
 
The guest-workers are pointedly used to transfer working methods and serve as liaisons to the off-shore operations.   Guest-work program encourage off-shoring; they are not a substitute for it.   Ron Hira of Rochester Institute of Technology confirmed this in his research.
 
Several other researchers and reporters have noted the prevalence of age discrimination in the same fields negatively affected by the H-1B visa program.   Most of them agree that the H-1B visa enables/encourages/facilitates that age discrimination, which kicks in noticeably for those as young as 35.   No, we're not talking about "stale" or "obsolete" knowledge, though it is interesting that STEM executives seem a lot less willing to invest in 2-12 weeks of new-hire training and 2-4 weeks per year of training for retained employees that was the norm before H-1B, and they also seem a lot less willing to fly US talent around the country for interviews or to invest in relocation assistance.   If they don't find exactly the bizarre "purple squirrel" they want, already within a few blocks, they go straight to the cheap, young, pliant, lower-skilled, foreign labor with flexible ethics.   (This has also promoted the focus on and proliferation of abominable privacy violation schemes as a core business plan.)
 
For example, the man behind the re-building (building, really) of India's telecommunications system was an Indian national, given a student visa, then a work visa at a US telecomm firm, where he learned parts designs, which he took with him to India, adapted, manufactured, and deployed there.   And when he got sick, he had to come back to the USA for treatment.   (This according to Gurcharand Das in his book _India Unbound_.)   The US university and hospitals, doctors, and nurses got little from the taxes he paid while in the USA; the firm from which he got his designs got no patent royalties, etc., from the knowledge they transferred to him and which he transferred to India, and though the Indian government thanked him enthusiastically, as soon as he turned into a cost center, they dumped him.
