1. The H-1B visa is a non-immigrant visa (which allows dual intent).
2. The H-1B visa is not restricted to the "high-skilled", but is open to all those with any level of skill in STEM fields and fashion modelling, and the "high-skilled" H-1B grantee is the rare exception; the data show that the vast majority are mediocre lights doing mediocre work for which there is a plentiful supply of able and willing USA citizens.
3. The H-1B visa program has always, from its conception several years before enactment encouraged displacement of USA citizen under-graduate students, graduate students, and STEM professionals -- both by blatant and direct displacement such as at Disney, Southern California Edison, NorthEast Utilities/Eversource Energy, etc., and by at least equally common but more hidden, indirect displacement.
4. Regardless, the excess labor depresses ethical standards, depresses compensation, depresses recruiting effort levels and techniques, and encourages discrimination on the basis of total compensation, age, and nationality.

"Yesterday, in an obscure federal court-room the future of American constitutional liberty hung in the balance and it was saved -- at least temporarily -- by the integrity of District of Columbia federal district court judge Richard J. Leon, the extraordinary efforts of Kris Kobach, the Secretary of State of Kansas and attorney J. Christian Adams of the Public Interest Legal Foundation, and a thin line of conservative ballot integrity watchdogs, including attorney Hans A. von Spakovsky of the Heritage Foundation and Richard Manning of Americans for Limited Government. The hearing before judge Leon was over the temporary restraining order (TRO) and preliminary injunction (PI) being sought by the League of Women Voters and a host of other leftist groups to stop the recent decision of the U.S. Election Assistance Commission (EAC) to allow Kansas, Georgia, Alabama, and Arizona to enforce their proof-of-citizenship voter-registration requirement. The U.S. Election Assistance Commission, as an independent federal agency, was to be represented at the hearing by attorneys of the Obama Department of Justice -- except as Hans von Spakovsky and Rick Manning predicted last week -- the attorneys for the [Obummer] Department of Justice were preparing to take a dive and betray their clients to the left-wing plaintiffs in the case. Rather than defend the legally appropriate decision of the Election Assistance Commission the [Obummer] DoJ lawyers filed a pleading in which they not only failed to defend the actions of the Election Assistance Commission, but agreed with the plaintiffs and consented to both a Temporary Restraining Order and a Preliminary Injunction -- in effect over-ruling the findings and actions of an independent executive agency. Fortunately, in an act of integrity that shows once again how fundamental to the preservation of constitutional liberty the president's judicial appointment power is, judge Leon called the pleading 'unprecedented' and 'extraordinary'. He said, as von Spakovsky reported in National Review, that he had never seen such a document in his entire experience as a lawyer or a judge. He was obviously astonished that the Justice Department was not defending the agency, and it was soon clear he was not going to allow DoJ to just roll over. According to von Spakovsky's account of the hearing, Judge Leon issued orders just before the hearing started granting the motions of both the State of Kansas and the Public Interest Legal Foundation to intervene in the case in order to defend the EAC's [Election Assistance Commission's] position. So Kris Kobach, the Secretary of State of Kansas, was given time to argue against the TRO motion, as was Christian Adams of PILF. The judge opened the hearing by reading into the record what attorney von Spakovsky called 'an astonishing letter' sent to judge Leon by the chair of the EAC, Christie McCormick. It informed the court that DoJ had told the EAC that it would not defend the agency, and that it would not allow the EAC to hire its own counsel. McCormick also informed the judge that she believed DoJ was not fulfilling its duty and obligation to defend the EAC and had a potential conflict of interest. It was clear that judge Leon was shocked at what DoJ had done reported von Spakovsky. He also said almost immediately that he would not grant a PI without a complete briefing and arguments on the case -- despite DoJ wanting to consent to the PI. Fortunately, in act of integrity judge Leon made clear that there was 'no chance at all -- zero' that he would do what the plaintiffs and the Justice Department wanted him to do on that issue. Hans von Spakovsky reported that judge Leon was obviously annoyed at the plaintiff's lawyer's inability to answer some of his questions, saying, 'I gave you the weekend to get ready for this -- what have you been doing?' Judge Leon talked about all of the cases in which the Federal Programs Branch has been involved in his court-room, and said he had never seen the type of incomplete brief that DoJ had filed in this case. He said that those briefs 'usually cover the waterfront' in terms of raising every legal argument to defend an agency. Leon was very dismissive of the DoJ's position, its behavior, and its failure to mount a defense consistent with its usual practice. According to von Spakovsky's reporting for National Review, the plaintiffs' lawyer was stumped by the judge on several occasions. One example: judge Leon asked about the requirements for voting in the upcoming primaries in Georgia, Alabama, and Kansas. The lawyer, who was there supposedly representing voters in those states, didn't know the basics about whether those elections were open primaries or caucuses or whether you have to register by party in those states in order to be able to vote. Secretary of State Kobach did a much better job than the plaintiffs in explaining why the plaintiffs had not met the standards for the issuance of a Temporary Restraining Order says von Spakovsky. Kobach pointed out the many errors and mistakes made by the plaintiffs' lawyer. And he laid out the evidence of non-citizens registering and voting in Kansas -- which is why this proof-of-citizenship law is needed. The battle to protect the integrity of the vote for the 2016 election is far from over; judge Leon ended the hearing by saying that he would announce his decision on the Temporary Restraining Order today (2016 February 23) according to von Spakovsky. "At a House appropriations hearing yesterday, attorney-general Loretta Lynch announced that her department has agreed to begin enforcing federal law against sanctuary policies that obstruct communication and cooperation with federal immigration authorities. Lynch's announcement is the result of pressure applied by representative John Culberson (R-Texas), who chairs the subcommittee that controls the budget for the Department of Justice. Under his plan, state and local jurisdictions maintaining sanctuary policies that violate federal law now risk losing federal funds -- unless they stop protecting criminal aliens. Sanctuary policies are a significant public safety problem and also make it more difficult for USAICE to deport aliens who get arrested for state and local crimes. Since 2014 January, more than 15K criminal aliens that USAICE was seeking to deport have been released back to the streets instead due to sanctuary policies. According to information I obtained through a FOIA request, most of these offenders had prior arrests, and one-fourth were already felons. After being freed, nearly one-fourth were again arrested for new crimes within a short period of time. The disclosure of this information last July, together with several widely publicized reports of Americans killed by illegal aliens who had been released by sanctuary jurisdictions, prompted Culberson to take action. Following passage of the 2016 omnibus spending bill, which enabled him to use his authority, Culberson put Lynch on notice. On February 1, he sent her a letter outlining 4 steps he expected her to take to ensure that state and local agencies that apply for federal funding are fully compliant with federal law, specifically 8 USC 1373. He further declared that if she did not do so, then it would be very hard for him to look favorably on certain future DoJ budget requests she might make, and that he would take action using his authority as committee chairman..."

As a general rule over the last 100 years, any time the USA has bombed or intervened and then abruptly left the targeted country, chaos has followed. But when America has followed up its use of force with unpopular peacekeeping, sometimes American interventions have led to something better. The belated entry of the USA into World War 1 saved the sinking Allied cause in 1917. Yet after the November 1918 armistice, the USA abruptly went home, washed its hands of Europe's perennial squabbling and disarmed. A far bloodier World War 2 followed just 2 decades later. It may have been wise or foolish for presidents John FitzGerald Kennedy and Lyndon Baines Johnson to have intervened in Vietnam in 1963-1964 to try to save the beleaguered non-communist south. But after 10 years of hard fighting and a costly stalemate, it was nihilistic for America to abandon a viable South VietNam to invading communist North VietNam. Re-education camps, mass executions and boat people followed -- along with more than 40 years of communist oppression... In contrast, when the United States did not pack up and go home after its messy wars, our unpopular interventions often helped make life far better for all involved -- and the USA and its allies more secure. The USA inherited a mess in the Philippines in 1899 after the defeat of imperial Spain in the Spanish-American war. But after more than a decade of bloody counterinsurgency fighting, America finally birthed a Philippine national government that was given its independence after World War 2... The choices are all awful. But the idea that the USA can bomb a rogue regime, leave and expect something better is pure fantasy."

"Well, I obviously gave Donald Trump too much credit in my posting before Thursday's Republican debate in Houston. I'd assumed it would be difficult for the other candidates to successfully go at Trump over his widespread use of guest-workers because they all want even more guest-workers than we have now (except for Cruz, who recently backpedalled a little). Or, as Fred Bauer put it: 'Attacking Trump on H Visas Will Be Difficult for Candidates Who Support H Visas'. But I guess Rubio counted on Trump's utter lack of preparation to avoid a counter-punch on Rubio's own support for massive increases in immigration, including guest-workers... Rubio's shamelessness is breathtaking, but fortune favors the bold. Not only did Trump not take the opportunity to deflect attention by gutting Rubio like a fish, as he could have. He actually went into full Jobs Americans Won't Do mode... Cruz and Rubio finally landed some blows against Trump in this debate..."

"A huge part of Donald Trump's surge to the top of the polls in the GOP nomination race is the perception that he's going to be tough on immigration. Exit polls from a number of states have shown that he's the favored candidate among voters who believe immigration is one of the most serious issues we face as a nation. But voters who think Trump will take a tough stand on immigration -- legal, illegal, visas, and guest-workers -- should consider his company's hiring track record. Last year, Reuters and some local media outlets in South Florida reported that Trump's company has used more than 1,100 guest workers via the H-2B visa program, which is for seasonal, unskilled, non-agricultural jobs. And on Thursday, the New York Times published an investigative piece detailing how extensively Trump's signature Mar-a-Lago Club in South Florida has utilized guest-workers. I wrote an in-depth report on H-2Bs in 2010, and I interviewed many H-2B visa applicants as a Foreign Service officer. The H-2B program is more or less despised by both sides of the immigration debate. The human rights community considers the program legalized slavery, and those who advocate stricter immigration enforcement believe that H-2B workers contribute to unemployment and wage stagnation for USA workers. But the business community loves [executives love] this program because it brings them cheap, reliable labor -- people who can't quit or demand better working conditions. Trump's company is certainly not alone in leaning on this program for guest-workers. And I'm sure his supporters will wonder why the media hasn't shown much interest in covering other companies that use and abuse the guest worker program. But when you put yourself out there as a guy who is going to champion American workers, as Trump has, you had better be prepared to defend your company's hiring practices. For his part, Trump has claimed, essentially, that it's hard to find good help these days, and that since this program is legal, there is nothing wrong. I suspect that very few voters will buy this argument. I combed through the government data-bases detailing H-2B petitions and here are some observations regarding the Trump Organization's use of H-2B guest workers: In petitioning for workers, employers are supposed to prove that their hiring need is 'seasonal' and 'temporary', yet Trump's Mar-a-Lago Club has sought to import guest workers year after year, including right now. (Their most recent petition was filed in 2015 July and the workers are on contract at the resort until 2016 May 31.) Trump maintained at the debate on Thursday night that the jobs he had filled with guest-workers were hard to fill because they were only for 90 or 120 days. But in fact, the duration of the petitions was never just 3 months. The work period for Mar-a-Lago's guest workers, according to the petitions, is nearly always October 1 to May 31, which is 8 months. On other occasions, his company petitioned for even longer periods. For example, in 2009, the Trump National Golf Club petitioned for guest-workers for the period January 26 through November 20. I note that even during the height of the recession, this and other Trump properties were petitioning for workers. In 2009, again, during the height of the recession, the Trump Organization used an H-2B broker called Más Labor to import workers. Más Labor extols the benefits of Mexican workers on their web-site, which allows employers to add guest-workers to their online shopping carts. 'You'll never wonder if your workers are going to show up on Monday morning and make it through a full work week.', it reads. 'MAS H2 workers are dedicated to their families, their work and their employers. They'll be there, ready to work hard for you... The only thing an H-2 worker can do legally in the USA is work for their specified employer... For Mexican workers, $7/hour to $9/hour is about 10 times what could be earned in most jobs at home.' Más Labor is run by Elizabeth Whitley, a former congressional aide who is on the board of Save our Small Businesses, a leading advocacy group that lobbies Congress for guest workers. As I reported in 2010, it is essentially a consortium of medium and large businesses that rely heavily on guest workers masquerading as a group of small business-people. (Trump's companies also relied heavily on another individual based in Ithaca, NY, Peter Petrina.) Based on the databases, it looks like the Trump Organization often pays workers exactly whatever the Department of Labor sets as the prevailing wage for that type of job and not a penny more. So, for example, in 2010 housekeepers at Mar-a-Lago got $7.44, but right now they get $10.07 as the prevailing wage has gone up. Many employers use shell companies and...bodyshops, which are brokers who petition for workers and then parcel them off to companies that need them. This means that the Trump Organization's use of seasonal guest-workers could be even more significant than what we see in the data-bases."

"The Department of Homeland Security (DHS) issued a press release this week announcing the signing of a series of repatriation agreements with the government of Mexico... The 9 local agreements provide for the mechanisms by which the United States can deport, or remove under the less-formal means of voluntary departure, Mexican nationals back to their country..."
What strikes me is that they refuse to release the full text of the 9 "agreements" or "arrangements", but only the "base text". And they are not binding treaties, won't be constitutionally ratified by the USA senate, but will be perversely touted as binding to the citizenry.

Does anyone imagine that Big Tech will not be helping candidates into whom they already have their hooks? This will be the at least the third election Big Tech has attempted to manipulate for their own benefit. Popular 'social media' sites are gradually tightening the screws on free political speech, by ranking posts according to secret formulas, which result in a carefully curated appearance that leans heavily toward their own private agenda. Search engines have it even easier. Just a small adjustment to the ranking criteria can move a popular discussion blog from page 1 to page 101 with no one the wiser. A simple ranking tweak can elevate Islamic results above Christian results, or one political candidate above another. Thus potentially billions of dollars in marketing influence can be donated to candidates and political parties without a single dollar appearing on a campaign contribution report. Us? Oh, no! We're totally neutral. While the ease with which this deception can be carried out is astonishing, even more so is that most of those attending these free re-education camps are supportive of the effort!... Yet beyond freedom, something even more precious remains for each of us to willingly hand over."

"Pig (cast) iron is high in carbon content (over 4%). It is very hard, but will crack or break under shock. It cannot be machined, which is why it is cast, that is, poured into molds to cool to shape. Wrought iron can be hammered, drilled, & otherwise worked. It will not break under shock & is highly resistant to corrosion, which makes it ideal for balcony railings & other open-air uses (cf. the Eiffel Tower). To get from pig to wrought iron, most of the carbon has to be burned off, leaving 1% or less. Wrought iron has long since been replaced by steel (1-3% carbon), which combines the virtues of both cast & wrought iron, that is, hardness with malleability; as a result, wrought iron is just about unobtainable today except as scrap. The difficulty with the early coke-blast iron was that, on refining, it yielded an iron that was red-short, that is, brittle when hot.
