"...There are, after all, only so many openings available to students at any university, including U of Texas.   Finally, to circle back, there is the question of what the federal government's response should be toward post-secondary education institutions that give favor to illegal aliens as students -- either through free education or via in-state tuition discounts.   After all, millions of dollars pour out of the federal government in various ways to colleges and universities large and small, public and private.   The supreme court ruled long ago that children who are illegally in the USA have the right to public education, but this stops at high school graduation.   It doesn't extend to anything further.   Even more curious is the oddly schizophrenic approach of the federal government toward post-secondary institutions accepting foreign students.   There is a whole regimen of rules and regulations; there is a particular control apparatus called the Student and Exchange Visitor Program (SEVP) to oversee those regulations; there is an electronic system in mandatory use by schools that officials in the SEVP use to monitor foreign students' attendance at the institutions; and, singularly, each and every institution proposing to accept foreign students must receive approval from the federal government to issue the forms that prospective students bring to consular officers to seek student visas.   But what is the point of that whole regimen if the government doesn't really care when such students over-stay or violate their status by quitting school, and expends virtually no time or effort to find them?...   And why make schools go through the approval process with the implicit (but mostly empty) threat of sanctions for failure to abide by the rules if the federal government is indifferent when they are willing to enroll students who never had a visa of any type, but came here after crossing the border without inspection [without backgrround check nor investigation]?"

"The Government Accountability Office (GAO) issued a report last week about the Visa Waiver Program (VWP), which permits citizens of approved nations to enter the United States as short-term visitors without the need to seek visas from USA consular officers.   Visa Waiver Program: DHS Should Take Steps to Ensure Timeliness of Information Needed to Protect USA National Security is the first report on VWP since the law creating the program was amended.   The workings of the VWP are of extreme interest to federal legislators in light of the spate of terrorist attacks the European Union (EU) because many of those states, such as Belgium and France, are VWP participants and some of the jihadi terrorists who committed the attacks were their own citizens.   Thus, the VWP has important ramifications for [USA] homeland security and it is for that reason that congress recently enacted, and the president signed into law, amendments designed to bolster the security aspects of the program, although [Obummer] then immediately issued waivers for key portions of the amendments [rendering them null].   GAO's recommendations surround 2 key findings:     First that the Department of Homeland Security (DHS) has been late with, or even failed to submit, mandated reports to congress on data and facts about participating countries that establish (or disprove) that they and their citizens who use the program to enter the USA are in compliance with its requirements.     Second, that participating VWP states are not routinely sharing information on terrorists and criminals, as required in the agreements underlying approval for their citizens to participate in the program, at least in part because DHS has not set deadlines to require compliance with the agreements and provision of this critical information..."

"Readers of my periodic blog posts will know that I am no big fan of the federal [9th circus court of appeals], almost certainly the most [leftist] of the federal appellate circuits, whose jurists are authors of some occasionally mind-bending legal acrobatics that throw common sense and logic to the wind.   One of my recent posts involved the [circus's] decision that alcoholism, because it is an illness, does not reflect badly on good moral character ('GMC'), possession of which is a requisite for many immigration benefits, including the most significant one of naturalization.   I noted at the time that drug addiction and pedophilia are also recognized disorders, and wondered whether the end road of the circuit's meandering in the wilds of GMC would result in findings that junkies and child-abusers would also be found to possess it.   In a recently published opinion of a case considered in April, United States of America v.   Ceferino Orden Olivar ii, the [circus] has made another decision with ramifications on the possession (or lack) of GMC.   In the Olivar case, the court upheld a lower court's decision to denaturalize a man who was convicted of conspiracy to commit visa fraud.   The conviction (taking place in 2009 April) was subsequent to his naturalization by a period of years (which occurred in 2002 May), but -- and this is the key point that the Court rightly focused on -- the conspiracy for which the man was convicted formed in 2001 July, prior to his naturalization, which by law requires the individual to have been a person of good moral character for at least the 5 years preceding taking of the oath of citizenship.   For once, we see a decision from the court that is well-reasoned and exhibits common sense; one that we can applaud because it upholds the value of American citizenship and the importance of good moral character.   It is particularly significant, given the relevance to the immigration and citizenship system of Olivar's underlying offense: conspiring to commit visa fraud.   Imagine the audacity of a man who, even while conspiring to defeat the lawful working of the immigration law through visa fraud, seeks to avail himself of its utmost and most cherished benefit -- the conferring of citizenship."

"...Because the right to use modern weaponry for the defense of life, liberty and property is natural, we should not need a government permission slip before exercising it, any more than we need one to exercise other natural rights, such as speech, press, assembly, travel and privacy.   Yet since the [Regressive era began] 100 years ago -- ushered in by Theodore Roosevelt and Woodrow Wilson and enabled by nearly every president since -- the government has taken the position that it can care for us better than we can care for ourselves.   So it has severely curtailed our rights and left us reliant on the government itself for protection.   The modern-day massacres are proof beyond a doubt that the government cannot protect us.   In the Orlando tragedy, the man who killed 49 and wounded 53 used a hand-gun and a rifle.   The hand-gun accepted magazines containing 17 bullets, and the rifle accepted magazines containing 30 bullets.   The killer, using both weapons, fired more than 250 times last Sunday morning.   That means he reloaded his weapons about a dozen times.   Each time he reloaded, he stopped shooting, as it is impossible for any person to shoot and re-load simultaneously.   We know from forensics that the killer was a poor shot.   We can deduce from that knowledge that he was a slow re-loader.   One learns to shoot first and reload later.   It is likely that it took between 3 and 7 seconds [possibly 15 to 20 seconds] each time he re-loaded the hand-gun and longer with the rifle.   In those time periods, any trained person carrying a hand-gun in that Orlando night-club could have wounded or killed him -- and stopped the slaughter..."

2 years ago, Eric Cantor lost in the primary running for re-election and John Boehner persuaded to resign after repeatedly doing more damage; did their removal happen soon enough? wouldn't we be a lot better off if McCarthy, McConnell, Ryan, Cornyn, Grahamnesty, Hatch, Reid, Pelosi, Gutierrez, Lofgren, Rubio and others had been replaced over the last decade?

They want incremental progress rather than regress and, repeated incremental advancements and gains rather than being clobbered by concession after concession after concession to the power-mad left and an ever-falling standard of living, repeated reductions in liberty and privacy.   But what we got were McConnell, Boehner, Cantor, Ryan, McCarthy... repeatedly giving up when it counted, before any serious negotiations had been tried, before the obvious tools in the constitutional and congressional rules had been utilized, repeatedly making life worse for the ordinary working people.   And now, since the very beginning of his campaign, Donald Trump hahs been advocating positive changes, improvements.   Oh, sure, we don't trust him fully to carry through, his tariffs are a big extreme and would risk trade-war, and a few of his other, less important positions are a little iffy.   We might've backed Scott Walker or Rick Santorum or Ben Carson if they'd been more forthright, principled, consistent...and hadn't thrown in the towell.   If Carly Fiorina had shown evidence of genuine reform on border security, visas, immigration, and trade the public might have lined up behind her.   But they didn't.   They softened, euphemized, temporized, tap-danced, waffled, ambiguated.   If Cantor were honest he would have dropped back.   Cleaned up his act.   Repented.   Reformed.   Re-started.   Earned his way back up.   Gotten work at legal aid, or as a construction laborer to show himself and others he could do honest work for a change.   Instead, he showed his corrupt tendencies.   Such a shame.
