"...Trump's statements on immigration...     'The number of new illegal immigrant families who have crossed the border so far this year already exceeds the entire total from 2015.   They are being released by the tens of thousands into our communities with no regard for the impact on public safety or resources.'     This statement is 100% true.   According to the Customs and Border Protection (USACBP) web-site, as of the end of June, with three months remaining in the 2016 fiscal year, 51,152 family units were apprehended crossing the border illegally.   There were 39,838 family units apprehended in all of FY2015, more than 11K less than the 2016 partial total.   As per Obama administration policy, nearly all are released...   The release policy was outlined in a statement by DHS Secretary Jeh Johnson on 2015 June 24.   The statement is silent on the cost to local taxpayers, although these have been documented to reach hundreds of millions of dollars nationwide for education alone, not counting health care, housing and other public welfare services.   The DHS statement gives lip service to considerations of public safety, but these words are contradicted in policy and practice...   new Census data reveal that illegal immigration surged significantly in 2014 and 2015.   'Nearly 180K illegal immigrants with criminal records, ordered deported from our country, are tonight roaming free to threaten peaceful citizens.'     This statement is 100% true.   Like the previous one, it comes directly from a federal government source, this time from USAICE.   According to the 2016 June 20, edition of 'Weekly Departures and Detention Report', the number of non-detained convicted criminal aliens on the Post Final Order Docket was 176,126...."

"...Trump pointed out that homicides were up nearly 17% in the largest 50 cities.   (The latest research actually shows a nearly 17% increase in the 56 largest cities.)   There have been more than 2K shooting victims this year in Chicago, he said, and more than 3,600 killed in Chicago since [president Barack Hussein Obummer] took office.   The overwhelming majority of the victims in this post-Ferguson shooting and homicide surge have been black.   In Baltimore, for example, 45 people were killed in 2015 July alone; 43 of them were black.   Baltimore's per capita murder rate was the highest in its history in 2015.   In Chicago, 2,460 blacks were shot in 2015 -- lethally or non-lethally -- or nearly seven blacks a day.   By contrast, 78 whites were shot in Chicago, or one every 4.6 days.   12 cities with large black populations saw murders rise anywhere from 54% -- in the case of Washington, DC -- to 90%, in Cleveland.   Trump's concern about rising crime is therefore not a concern about white victims and the loss of white life.   Rather, it is a concern about black lives.   As Trump said: 'young Americans in Baltimore, Chicago, Detroit, Ferguson...have as much of a right to live out their dreams as any other child America'.   Hint to the media: He was referring to black children in those cities, such as the 10 children under the age of ten killed in Baltimore last year; the 9-year-old girl fatally shot while doing homework on her mother's bed in Ferguson, Missouri, in 2015 August; and the nine-year-old boy in Chicago lured into an alley and killed by his father's gang enemies in 2015 November..."

"...Two clarifications have emerged recently on the matter of discrimination in favor of certain mixed families, including aliens, in the food stamp eligibility rules.   As we reported in a CIS Backgrounder, under some circumstances a mixed family including an ineligible alien wage earner can secure food stamps when an identical, all-citizen family (same number of people, same income) is ruled ineligible.   But thanks to one error on the part of the USA Department of Agriculture, and another on my part, 2 clarifications are required.   The tilt in favor of some families containing either illegal aliens or people with relatively new green cards is caused by differential treatment of the incomes; if an ineligible alien is the bread-winner, then that person's income is partially discounted, making it easier for that family to have a low enough apparent income to secure benefits.   There is no discount on the income of a citizen in the family.   We pointed out that a mixed family of 3 with an income of $2,400 a month would be eligible for food stamps (2 allocations) while an identical all-citizen family would not be eligible at all.   This is the case because one-third of the alien’s income is discounted.   Geography.   One of the complexities of what is now called the Supplemental Nutrition Assistance Program (SNAP) is that there are policy options within the national guidelines that may be adopted by the states and territories.   One of these options is the choice of whether to use the just-described anti-citizen alternative, called 'proration' in the trade.   We reported that five states (Arizona, Massachusetts, New Mexico, North Carolina, and Utah) and Guam have opted to treat the citizen and the mixed families equally, and did so based on a current Department of Agriculture document (see p. 11).   Kansas is the sixth state to avoid proration, but this did not register with USDA's report; it did register with Alex Pfeiffer of the Daily Caller, however, who wrote to us about it..."

"'I have visited the laid-off factory workers, and the communities crushed by our horrible and unfair trade deals.   These are the forgotten men and women of our country, and they are forgotten, but they will not be forgotten long.   These are people who work hard but no longer have a voice.   I am your voice...   I pledge to never sign any trade agreement that hurts our workers, or that diminishes our freedom and independence.', [said] Donald Trump [in his] presidential nomination acceptance speech.       Like no other politician in recent history, Donald Trump is a tuning fork who resonates to the concerns of millions of ordinary Americans in the working classes.   He has thrown conservative orthodoxy into chaos in his path to the nomination, and breathes so hotly on Hillary Clinton's neck as she too seeks the presidency that it has forced her to choose a running mate perceived as enough of a centrist to counterbalance her leftward lunge, in hopes of retrieving enough of the independent vote to help her win.       One of the areas in which Trump has broken the bubble by speaking [what the extreme left claim should be] unspeakable, often in unrefined... ways, is immigration.   Many so-called conservatives who [claim they] find the Trump vision for America offensive to their views themselves possess shockingly [lax] attitudes toward immigration enforcement.       [RINO] House speaker Paul Ryan is one such conservative, as was senator Marco Rubio, who plunged from the heights like Icarus, his campaign aflame from his association with the infamous and deceptive [and offensive] Gang of Eight mass amnesty bill [S744, and subsequent bills to worsen the flood of cheap, young, pliant, low-skilled guest-workers].   Trump's seizure of the immigration issue and insistence on the need for real border security not only helped catapult him into the Republican Party nomination, but has clearly put these [pseudo-conservatives/RINOs] and their [offensive] ideas toward sovereignty vs. unfettered illegal immigration on the defensive.       Free trade, one of orthodox Republicans' most sacred scriptures, an orthodoxy shared by many liberal Democrats, has also come under Trump's withering gaze.   He has grasped the nexus between trade deals and immigration, and their cumulative effect on white and blue collar America's slipping hold on the ladder of economic well-being.       For decades, Americans have been told that we must engage in free trade deals to open up markets to our exports and remain competitive in the global market.   The North American Free Trade Agreement (NAFTA), the mid-1990s grand-daddy of trade deals, was brokered during Bill Clinton's presidency.   Americans were led to believe that NAFTA would not only create American jobs, but many in Mexico as well, thus creating an impetus for Mexicans to remain home instead of crossing the border illegally to seek jobs in the USA -- a win-win situation if ever there was one.       A substantial number of 'maquiladoras' (factories) did indeed open up in northern Mexico, but as often as not they were [not new factories, but] relocated USA factories, making the American Rust Belt all that much rustier although corporate profits rose significantly on the labor cost savings.   Even now, 'researchers' are suggesting that Rust Belt cities and their denizens should be comfortable with their diminished status and 'embrace smart decline', as if urban decay were not only inevitable but acceptable.       Other maquiladoras were established by foreign firms wanting free and direct access to USA markets while producing goods at a fraction of the labor costs American workers would expect.   Locating factories in Mexico achieved this goal, but at the expense of American workers and consumers.   [But many of the Mexican workers were also scammed, as they up-rooted for the chance to work at the border maquiladoros, turning some of their un-supervised children into delinquents & gangsters, and then closing down and evicting those workers and their families as the factories moved to Red China and India and VietNam in search of even more cheaper, younger, more pliant labor.]     [30-plus] years and several trade deals later, ordinary Americans have reason to be skeptical.   Free trade seems less like an 'everyone benefits' enterprise and more like a zero-sum game practiced at the expense of our working class; one in which there are clear winners ([executives, large corporate share-owners], and foreign workers) and clear losers (American workers).   Although it's clear that Mexican maquiladora workers, and their counterparts elsewhere we have trade deals in effect, were [at least temporarily] boots-trapped up the economic ladder, the number of illegal aliens from Mexico and other countries has not dried up; and 'off-shoring' has become a favorite way to dodge USA taxes and labor costs while still leaving markets open to their products.       Some of the free trade deals have had codicils that open up the door to foreign workers who siphon off available jobs.   But even in the absence of such codicils, the same [ckrony socialists and so-called] free-tradists who advocate such deals have been instrumental in wedging open non-immigrant worker visa programs that have been so poorly crafted, and so distorted by the regulatory acrobatics of the [Obummer regime], that [hundreds] of thousands of aliens willing to work for less money flood into our country yearly, sometimes replacing pink-slipped Americans who are obliged to train these new hires as they themselves are being pushed out the door.   These non-immigrant workers often fail to leave when their work permits are expiring, choosing instead to join the pool of millions of other illegal aliens living and working in the USA.   [Meanwhile, USA expertise, intellectual property, and national security secrets have been pouring out of the USA.]       Trump's [better-negotiated trade treaties] message (one shared by Bernie Sanders before he was tamed by the Democrat machine) resonates because it vocalizes the insecurities and outrage working Americans feel over repeatedly being had by bad trade deals such as the Trans-Pacific Partnership pact (TPP) with codicils so secret the White House didn't want Congress to see them, a situation that our Republican-dominated House and senate initially seemed content to accept (as they did with the Iran nuclear 'non-treaty' [hence unconstitutional] deal) until public outrage forced them to table the deal.   Note, though, that the TPP is not dead and could be resurrected by Ryan and other free-tradists if they feel they could manipulate the rules skillfully enough to shepherd it through congress.       In laying out his anti-globalist position, Trump has appalled many of the Republican [who advocate free-trade but don't necessarily recognize that NAFTA, GATT, GATS, TPP, TATIP, TiSA, etc. are not actually FREE trade, but trade rigged against middle-USA, and middle-UK for that matter] (again, such as Ryan) -- but along the way he has also forced Hillary Clinton to do one of her signature flip-flops on the TPP and decide that it was, after all, a bad idea, a change in position noted by Americans even if generally glossed over by most of the media.       But the reality, as ordinary working Americans know or suspect, is that:   Our wages have stagnated;   More heads of families are forced into working 2 or 3 jobs [if they can get them], often temporary in nature or minus health, pension, or other benefits [because more and more of the jobs to be gotten are contingent and part-time];   The median earnings of Americans in 2014 fell to 1996 levels; and   As Backgrounders from scholars writing for the Center have shown, most new jobs have gone to immigrants, not Americans (see here and here).       Given these facts, it inevitably forces one to question whether 'it make[s] sense to continue to admit a million new permanent immigrants each year, along with several hundred thousand guest-workers, given the enormous pool of working-age people not working', as well as whether it makes sense to continue to plow forward with new trade agreements when the old ones have shown themselves full of promise but empty of delivery.       Of course, it's early days yet and impossible to know whether or not Trump will win or lose the presidency.   Should he lose, there will no doubt not only be a lot of Democrats, but even establishment Republicans, breathing a hidden sigh of relief that the hurricane has passed.   They may be inclined at that point to think of the Trump phenomenon as one of those occasional and anomalous eruptions in the American body politic -- call it the 'Ross Perot effect' -- that blows over as quickly as it came, leaving business and politics to continue as usual.   This time, it's not so clear that would be true.   It may be difficult to put the whirling, spinning genie of working class discontent back into the bottle."

"In our new book _Sold Out: How High-Tech Billionaires & BiPartisan BeltWay CarpWeasels Are [Destroying the Lives, Families, and Careers of the USA's] Best & Brightest Workers_, Michelle Malkin and I explain in detail the provisions of the H-1B program and the H-1B provisions of Marco Rubio and Chuck Schumer's cynically misnamed 'Comprehensive Immigration Reform' [when it should be truthfully named 'Reprehensible Immigration Law Perversion'].    
I previously did the same for Rubio and Orin Hatch's I-Squared Act that we say should be more appropriately called the 'I'm Screwed Act' in _Sold Out_.    
There are now 3 bills that have been introduced in the senate to address the rampant abuse in the H-1B program.   I will give them the same scrutiny and go through the provisions of each bill in detail.    
The next bill up is the H-1B and L-1 Visa Reform Act of 2015.   This bill is sponsored by senators Grassley, Durbin, Nelson, Blumenthal, and Brown.    
Section 101 of the bill changes the prevailing wage requirements of the H-1B program.   Currently, 8 U.S.C. § 1182(n)(1) requires the employer to pay the 'prevailing wage'.   However, 8 U.S.C. § 1182(p) redefines the prevailing wage (normally the 50th percentile) for H-1B purposes so that the employer can pay the worker at the 17th percentile.    
In San Francisco, the average wage for a computer programmer is $104,770 a year [and bying a cheap starter home requires an income of at least $117K-$125K (inflation continues)] but, under the current law, an employer can pay an H-1B programmer $66,518.   This is why H-1B workers are concentrated in high wage locations in the USA.      
The Grassley bill requires the H-1B worker to be paid the higher of:     The prevailing wage (which can be the 17th percentile in 8 U.S.C. § 1182(p)).    
The median wage (the 50th percentile).    
The median wage for skill level 2 (the 34th percentile).    
There text is longer than necessary because the second option will always be the highest wage of the three.      
This section of the bill also requires posting for 30 days a job description and how one may apply for the job.    
It bans replacing Americans with H-1B workers.    
It bans placing H-1B workers with another employer unless the employer applies for a waiver with the Department of Labor in which the employer certifies it will control the workers and the workers will not be used to replace Americans.   The Department of Labor has discretion to grant or deny the waiver.    
Section 102 bans recruitment targeted towards hiring H-1B visa holders, limits employers to a maximum of 50% of its workers on H-1B visas, and requires the employer to submit W-2 information to the Department of Labor to show proof that wages have been paid to the workers.    
Section 103 addresses the most notorious provision in the H-1B program.   The first step in the H-1B process is for the employer to file a Labor Condition Application (LCA) with the Department of Labor.   This is where the employer certifies that it is paying the 'prevailing wage' and conforming to the rules of the H-1B program.    
Under current law, the Department of Labor is required to approve all LCAs within 7 days as long as the form is filled out correctly.   Consequently, industry lobbyists have fought to the mat to preserve this requirement that allows employers to abuse the system with impunity.   In fact, many bills that increase the number of H-1B visas try to mislead the public by rewording this provision to no effect.   Sold Out describes in detail how the Rubio/Schumer 'Comprehensive Immigration Reform' [i.e. Reprehensible Immigration Law Perversion] would have reworded this provision to no effect.    
This bill does the obvious and just deletes the restriction on the approval process.   It also allows the Department of Labor to investigate when LCAs show a pattern of abuse.   Under current law, the Department of Labor is prohibited from reviewing LCAs after they have been approved.    
Section 104 changes the process for allocating H-1B visas and is the most complex part of the bill.   Currently, 8 U.S.C. § 1184(g)(3) requires H-1B visas to be allocated in the order petitions are filed.      
The Grassley bill requires H-1B petitions to be considered in this order:   Aliens in the USA with advanced degrees in science, technology, engineering, or mathematics from an American school.    
Aliens that will be paid at the 67th percentile for occupation and location.    
Aliens in the USA with advanced degrees.    
Aliens that will be paid the median wage or higher.   (This is redundant, given the requirements in § 101 of the bill).    
Aliens in the USA with degrees in science, technology, engineering, or mathematics from an American university.    
Aliens in the USA with degrees from an American university.    
Aliens who will be working in occupations where the Department of Labor has determined there are not sufficient American workers.    
Petitions filed by employers meeting specific criteria of 'good corporate citizenship'.    
All other H-1B petitions.      
Section 105 addresses the academic exception from the H-1B quotas.   That exemption was created to exempt aliens employed 'at an institution of higher education'.   In a typical example of agency abuse, DHS started interpreting the exemption to apply to anyone working at a location owned or controlled by a university.    
This provision changes the word 'at' to 'by'.   The fact that congress would have to make such a change illustrates the absurdity of the supreme court's 'Chevron Doctrine'.    
Section 106 of the bill restricts H-1B visas to those who have a college degree.   Currently, H-1B eligibility is determined by the occupation.   If the job is in a specialty occupation (one that normally requires a college degree) an alien can get an H-1B visa without having a degree.    
Section 107 directs the Department of Labor to charge a fee for filing an H-1B Labor Condition Application (LCA).   Currently there is no change and there has been legislation to prohibit the Department of Labor to charge such a fee.    
Section 108 expands subpoena authority to the Department of Labor for H-1B-related investigations.    
Section 109 reduces the maximum duration of an H-1B visa from 6 years to 3 years.   However, it still permits extensions when the alien has a green card petition.    
Section 110 addresses another area of agency abuse.   Although aliens on B visitor visas are prohibited from coming to the USA for employment, the State Department's consulates in India have created a program called B in Lieu of H-1B (BILO) that allows certain aliens to work on a visitor visa instead of H-1B (a practice waiting for a law-suit challenge).   The Grassley bill would ban the practice of BILO.    
The remainder of the bill addresses the L-1 intra-company transfer visa.    
Section 201 prohibits the sub-contracting of aliens on L-1 visas to other companies unless the employer certifies the alien will not displace American workers and will operate under the control of the employers.    
It also unequivocally makes it unlawful to replace Americans with L-1 workers.    
Section 202 applies to employers coming to open new offices.   It requires the employer to have a business plan and a bona fide office space.    
Section 203 is short and requires the Secretary of Homeland Security to work with the Secretary of State to verify that companies employing guest-workers actually exist.     Section 204 is lengthy and requires the establishment of a process for receiving and investigating complaints of violations.    
Section 205 effectively requires aliens on L-1 visas to be paid at least the median (i.e. prevailing wage [for a common, widely-available, mediocre doing mediocre kinds of work, but well below reasonable compensation for one of the 'best and brightest' with rare, hard to find knowledge, talent, and extra-ordinarily high skill-level]).    
Section 206 imposes penalties for violating the provisions of the L-1 program.    
Section 207 prohibits retaliating against an employee for disclosing violations.    
Section 208 requires the Secretary of Homeland Security to establish a procedure for processing blanket petitions for L-1 visas.    
Section 209 requires the Secretary of Homeland Security to provide Congress with annual reports on H, L, O, P, and Q visas.   Currently such reports only exist for H visas.    
Section 210 redefines 'specialized knowledge' to limit the eligibility of L-1B visas.    
Section 211 contains a minor change replacing the Attorney General with the Secretary of Homeland Security."

"...From the late 1940s to the mid-1950s, black youth unemployment was slightly less than or equal to white youth unemployment.   Today black youth unemployment is at least double that of white youth unemployment.   Would anyone try to explain the difference with the argument that there was less racial discrimination during the 1940s and 1950s than today?...   Today's black illegitimacy rate is about 73%.   When I was a youngster, during the 1940s, illegitimacy was around 15 percent.   In the same period, about 80% of black children were born inside marriage.   In fact, historian Herbert Gutman, in an article titled 'Persistent Myths about the Afro-American Family' in the _Journal of Interdisciplinary History_ (1975 Autumn), reported the percentage of black 2-parent families, depending on the city, ranged from 75% to 90%.   Today only a little over 30% of black children are raised in two-parent households.   The importance of these and other statistics showing greater stability and less pathology among blacks in earlier periods is that they put a lie to today's excuses.   Namely, at a time when blacks were closer to slavery, faced far more discrimination, faced more poverty and had fewer opportunities, there was not the kind of social pathology and weak family structure we see today..."

after years of relative inattention, members of congress are focusing on the continuing problem associated with countries refusing to accept their nationals who have been ordered deported from the USA
"...The bad news is that at least some of the congressional attention -- for however long it lasts -- is due to the unfortunate and avoidable murder of a young woman in Connecticut by a Haitian national, Jean Jacques.   Haiti refused to accept him after he was ordered removed, having been released from prison after conviction for attempted murder.   Because repeated attempts to obtain repatriation documents from Haitian authorities failed, Immigration and Customs Enforcement (USAICE) officials ultimately released him from detention, and he went on to murder the woman, Casey Chadwick.   The worse news it that Ms. Chadwick was not the only such victim.   Sadly, there have been a number of them, sometimes because the release was from USAICE custody; often enough because of the ill-conceived sanctuary policies of states or local governments that choose to let aliens walk free rather than putting them into the custody of USAICE after they are released from state or local confinement.   This attention on the part of law-makers has manifested itself in bills introduced in both chambers of congress to try to do something about the festering and unacceptable situation of noncooperation by other countries.   Current law obliges the secretary of State to discontinue granting both immigrant and nonimmigrant visas upon notice from the secretary of the Department of Homeland Security (DHS) to a that nation denies or unreasonably delays accepting return of a citizen, subject, national, or resident of that country.   (Section 243(d) of the Immigration and Nationality Act (INA), codified at 8 USC Section 1253(d).)   Unfortunately, as Center for Immigration Studies Legal Policy Analyst Jon Feere has noted repeatedly, the existing legal authorities have almost never been exercised (see here and here).   Jessica Vaughan, director of policy studies at the Center, has also published a number of compelling studies (see, for instance, here, here, and here) documenting the shocking number of releases of criminal aliens back into communities across America, many of whom have been released because they cannot be repatriated and the supreme court rules enunciated in Zadvydas v. United States therefore require that they be let go..."

"Donald Trump took to Twitter last night...   Unsurprisingly, the public responded in largest numbers to his tweets referencing immigration.   The most popular tweet, which quickly received close to 13K re-tweets and almost 32K likes, mentioned Hillary's push for a 550% increase in refugees while refusing to mention radical Islam.   Runners-up were tweets saying Hillary was 'owned' by Wall Street and her vision of 'a borderless world where working people have no power, no jobs, no safety'.   The public's enthusiastic response to these short and specific statements should remind both candidates of the broad spectrum of anxieties that Americans feel regarding the increases in both legal and illegal immigration [and student visas, and exchange visas, and exchange work visas, and internship visas (F-1 + OPT), and guest-work visas...   with zero in the way of serious efforts to investigate visa applicants].   Americans legitimately fear the unprecedented large and increasing number of refugees entering the country who cannot be adequately vetted to interdict potential terrorists.   Americans also object to the non-stop flow of thousands and thousands of foreigners streaming into the country with leaders unable or unwilling to stop or control the numbers.   But security is not the only issue, it's also jobs, the corporate elite's financial benefit from immigration [and work visas] to the detriment of poorer Americans [and middle Americans], and so much more.   Immigration might well be the political issue that decides the 2016 presidential election.   Voters care about immigration -- the only public policy issue that impacts all other issues, including national security, crime and community safety, wages and employment, fiscal policy, education, healthcare, the drug epidemic, and the environment.   So which presidential candidate advocates policies that keep America safe, help the economy, the American worker and families?     The contrast between the two candidates' immigration views could not be more distinct.   Nowhere has the difference been more apparent than on the stages of the recent national conventions.   The Republican National Convention highlighted the rule of law and the impact Americans feel from crime perpetuated by illegal aliens who would not have been in the country if laws were enforced.   The parents of those who died at the hands of illegal aliens took the stage and told their stories, pleading that immigration laws be enforced so other families do not suffer the same pain..."
