"Massive replacements of American workers by foreign workers using the H-1B and other guestworker programs have been going on since at least 1994.   Congress's response to these outrages over the decades has been to hold hearings on the subject and then do nothing.   In a 2016 February senate Judiciary committee hearing I made the prediction that the only thing that would fix this problem is executive action by a President Trump...   Yet it does not take much imagination to find provisions in the immigration code that could be used to protect [USA citizens]...   This provision has an odd history.   A similar provision was created in the Immigration and Nationality Act of 1965.   However, the story gets a bit complicated with the Immigration Act of 1990.   The drafters of the 1990 act operated with a level of incompetence and malevolence never seen previously in immigration statutes...   The very next year, Congress enacted the Miscellaneous and Technical Immigration and Nationalization Amendments of 1991 that changed the provision's applicability back to its current 'any alien'.   Even though Congress explicitly changed the applicability of 8 U.S.C. § 1182(a)(5) from EB-2 and EB-3 green card petitions to "any alien", this provision has only been consistently applied to those green cards.   I say 'consistently' because over the years the executive has claimed 8 U.S.C. § 1182(a)(5) as authority for deporting aliens with other visa statuses.   While it takes much imagination to find that 8 U.S.C. § 1324a(h) gives the president unlimited authority to allow aliens to work in the country, the plain text of § 1182(a)(5) explicitly gives the executive the power to exclude aliens who 'adversely affect the wages and working conditions of workers in the United States [of America] similarly employed'.   Imagine the next Disney situation when an employer tells hundreds of Americans they are being replaced by foreign workers and have to train those replacements to collect unemployment.   Those workers then complain to the Department of Labor.   Instead of encountering an unsympathetic [president Barack Hussein Obummer, Shrub, Clinton, or GHWBush], a patriot like president Donald Trump could step in and deport the foreign replacements.   Even the New York Times editorial page would have a hard time criticizing President Trump for such an action.   The next company [executive who] tries to pull a Disney could find [himself] left high-and-dry with [his] foreign workers [whether employees or out-source contractors or OPT interns] getting the boot from the country [and its means to facilite off-shoring impaired]."

Maybe she is intelligent.   Maybe she is an alpha bureaubum... the best of the breed.   (But how would anyone know?)   Maybe she is an accomplished conversationalist.   Maybe she is a knowledgeable scholar or has earned wisdom through hard knocks about something...even several things.   But as Labor secretary, she was a do-nothing-good position-holder at a time when bright, knowledgeable, industrious, creative USA citizens in several fields were being crushed by the job markets, and she seemed to do nothing at all good and many things at least moderately bad.   She did not push congress for positive reforms.   She did not encourage employers to invest in relocation and training and retention of able and willing USA citizen talent.   At that, she is no worse than the GHWBush, Clintoon, and Obummer appointees in the post.   If she performs as poorly at Transportation as she did at Labor, the USA and transportation infrastructure are doomed.   We do NOT need under-performers and non-performers, now.   We need over-achievers, over-producers.   Great people for a Great USA.   We certainly do NOT need Mitch McConnell or anyone else closely associated with him.   Laura Ingraham or Michelle Malking could do better.
 
Moving along to possible appointments for other posts.   I see no "qualified" possibilties for Treasury on the list.   Jon Bolton is the only one possibly competent for State.   Several look good for DoD.   Kobach and Clarke both seem pretty good for DHS, but there are a lot of good former INS, FBI, etc., who merit consideration.   Joe Arpaio is a good sheriff, might make a good manager for a state bureau of investigation or high-way patrol organization, or head of US ICE within DHS.   EPA is more difficult; too many EPA directors have gone rogue, power-mad, while some have been lax.   "Those most interested need not apply" would be a good rule-of-thumb.
 
For Energy, we need someone who can skillfully disassemble it without hesitation, without getting bit by the power-madness bug.   (Ditto for Education, HUD, HHS and nearly all of the associated agencies, GSEs/quangos.)
 
Palin and Brewer are knowledgeable about some Interior issues, and good administrators, but they should also be working to pare the department back.   Interior has some serious, periodically recurring, misbehavior, glitches, power-madness issues that need to be cleaned up.   Neither is a polished PR tour-de-force, quick with just the correct snappy phrase or snappy retort with just the right tone, but that is OK.   They have generally good intent and are mostly, kind of, more than moderately good.
 
Commerce: surely you jest.   Commerce really does need a swamp-draining.   Census and BLS need to be impressed with the importance of respect for privacy and "need to know" (maybe a few 48-hour sleep-overs in federal holding pens), but they have the best public data reporting of any department or agency (with room for improvement, but they should send the occasional visiting expert over to Education, DHS, etc.).   The "Small Business Administration" is a massive crony socialist farce.   The DNI possibilities all seem pretty good, but need close supervision...which, since they should be delivering briefings to the executive multiple times a day should not be too difficult.   USTR should not be someone from Nucor.   It should be a great win-win-win negotiator, standing tough for the USA and not just exporters, with a rock-solid foundation in fundamentals of economics (and preferably Austrian school economics).
 
DoL appears to require an active search for someone able and willing, someone with some leadership, certainly not someone whose only view of current Labor issues is from the executive suite and board-room.   A team leader, perhaps a retired military officer.   Someone who has been unemployed for a few months and gotten doors slammed in his/her face, who has sent out a few thousand resumes with nary a response showing any sign that the resume has actually been read by a thinking conscientious intelligent human being: employment broker, head-hunter, permanent placement agent, hiring manager.   Yes, it requires someone who knows a little labor law, too, but there are plenty who can fill that void in the department and can advise the secretary.   There are plenty of adequate bureaucracy managers.
 
HUD and HHS are some other departments requiring at least nearly complete eradication.
 
Though there are issues on which I disagree, Andrew Napolitano should be on the list of court appointees.   The list should start much longer, to handle the administrative, district, and appeals appointments needed, then a select 1-3 dozen examined far far far more closely and critically by both president-elect Trump and the senate.
 
Choose people you think are more knowledgeable and smarter than you think you are...and get letters of resignation before they are sworn in, while keeping your list of next 6 best choices, so that disasters can be handled quickly and smoothly.
