"The Center last week published a blog post of mine on enforcing immigration laws in the face of civil disobedience.   In it, I argued for reinstituting the use of 'Blackie's warrants' as one method of taking into custody aliens who refuse to cooperate with their deportation when they are under final orders of removal.   I described in some detail exactly what a Blackie's warrant is: a judicially issued civil search warrant used as authority to detect and take custody of aliens illegally in the USA.   But could they have potential for counteracting 'sanctuary' rules that impede federal authorities from taking into custody aliens arrested by police for criminal offenses, when they are also deportable -- either for those crimes or for other offenses, including especially reentry into the USA after having been previously removed?   I continue to maintain that such sanctuary laws and policies violate the supremacy clause of the Constitution because it assigns to congress the sole authority to establish uniform rules of naturalization, which has been more broadly [mis-interpreted] by the supreme court [contrary to article 1 section 10] to mean 'immigration'..."

Gordon of Northwestern University, dislikes technology.   Just the opposite: He's fascinated by it, and almost all his 762-page masterpiece describes the huge gains, mostly derived from new technologies, that have transformed daily life since the late 1800s.   Until then, writes Gordon, 'life and work were risky, dull, tedious, dangerous and often either too hot or too cold'.   Take laundry.   It involved the 'most physically demanding' household chore: hauling water.   Before washers and dryers, 'washing, boiling and rinsing a single load of laundry used about 50 gallons of water', estimated an 1886 study.   Housewives had to lug that water from outside, often 8 to 10 times a day.   We all know what happened.   Primitive conditions gave way to modern amenities and technologies.   In 1870, there were no homes with electricity, and few -- if any -- with indoor plumbing or central heating.   By 1940, about 40% of homes had central heating, 60% had flush indoor toilets, 70% had running water and 80% had electricity.   But in some ways, we succeeded too well, suggests Gordon.   The spectacular advances conditioned us to believe that rapid technological progress is an inherent feature of our economic system.   Invention and innovation can be dialed up to solve any problem..."

"Forgetting completely the old, and excellent, rule that tight labor markets are a worker's best friend, the Department of Homeland Security has just loosened the labor markets for several small groups of foreign workers.   Its press release said:   'This final rule does not impose any additional costs on employers, workers or any governmental entity.'   What it should have said is:   'Although this involves substantial economic costs to resident workers (citizens and green card holders), this final rule does not impose any additional costs on exploitative employers, indentured foreign workers or any inefficient government entity.'   Note the focus of the press release on the benefits to employers, rather than to resident workers.   Also note the careful avoidance of the word alien or foreign as it touts the benefits for workers without telling us that they come from somewhere other than the USA.   (As a former PR man for a government agency, I recognize the use of weasel words when I see it.)   Let's get to the substance of the new rule, as spelled out in detail in the January 15 Federal Register.   This is no casual issuance; my poor old HP printer ground out 47 pages of Federal Register copy before it sighed and stopped.   I hate to think how much DHS executive and clerical time was devoted to these new regulations, and all to benefit small groups of employers hiring small groups of indentured alien workers.   Unless the reader is deep into visa trivia, the list of visas may mystify, but they are: H-1B1, E-3, CW-1, and EB-1.   Briefly, they can be described as follows:   H-1B1 workers are [a special set-aside of H-1B visas for] (professional level) workers from Chile and Singapore, nations that send us very few such workers under trade treaties that created these categories.   (There were 870 visas issued for both countries in 2014, according to the State Department.)   E-3 workers are similar non-immigrant workers, but from Australia, another anomaly in the system.   (There were 4,492 visas in 2014.)   CW-1 aliens are non-immigrants located in the Commonwealth of the Northern Mariana Islands (hence CW) and may not use that status to come to the rest of the United States.   (There were 2,112 visas in 2014, but there is a larger number in the islands with visas issued earlier.)   Unlike the other categories, these are largely manual workers, clerks, and household servants.   EB-1 immigrant workers, a highly useful class of immigrants consisting of outstanding professors and researchers; there were about 7K of them admitted in 2012 and in 2013..."

"Details of the USA-Iran prisoner swap have been finding their way into various media accounts, some of which I have found passing strange (the details that is, not the media, although on sober reflection the latter's probably a truism too).   Note, though, that it is probably more accurate to describe this deal as a trade-off, and not a Cold War-style Checkpoint Charlie 'swap', for reasons discussed below.   The abridged version: Iran has released a total of 5 USA citizens, some (perhaps all) of whom appear to have been arrested and held on trumped-up charges.   In return, the United States has released, pardoned, or dropped charges against seven individuals, and agreed to withdraw Interpol 'red notices' against another 14.   Oddity No. 1:   All of the individuals to whom the United States has granted pardons, clemency, or the like had been charged, convicted, or were serving sentences for violating federal laws related to stealing secrets, defense materials, or military hardware for illegal transfer to the Islamic Republic for use by the Iranian Revolutionary Guard Corps (IRGC) -- you know, the same ones who recently seized at gunpoint, and held hostage, [USA Navy] sailors who inadvertently strayed into waters claimed by Iran in the Persian Gulf.   (The seizures, of course, gave the Iranians a prime opportunity to examine the 2 Navy vessels in great detail.   One wonders what marvels of GPS, radar, or sonar technology just got transferred as a result.) IOW, when you strip away the niceties, all of the individuals on the USA side of the trade were engaged in espionage against us on behalf of a rogue regime.   This is apparently because they were the ones the Iranians pressed hardest to have released.   Significantly, one person not swapped by the Iranians was Robert Levenson, alleged to be a CIA contractor doing clandestine work in Iran at the time of his capture.   They deny even knowing where he is, but the denial lacks credibility.   Oddity No. 2:   Media have described 6 of the 7 released as 'dual nationals' of the USA and Iran -- the seventh was born in the USA to Iranian parents; the other 6 are naturalized USA citizens originally from Iran.   Here's the thing: when you take the oath of naturalization to become a USA citizen, among other important things, you swear to:   'Renounce and abjure absolutely and entirely all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which the applicant was before a subject or citizen;' and to   'Support and defend the Constitution and laws of the United States against all enemies, foreign and domestic.'   If the individuals took this oath in good faith, how can they possibly be 'dual nationals'?   But it's pretty clear from subsequent events that they didn't take the oath with any meaningful intent (other than to gain citizenship, with the pathway that it gives to jobs with access to government defense secrets and equipment).   Why else were they stealing them on behalf of a nation avowedly hostile to the United States (the "Great Satan"), and that is a state sponsor of terror through use abroad of its radical Quds Force (a part of the IRGC) and its support of designated terrorist groups Hezbollah, Palestinian Islamic Jihad, and Hamas?   And why else would these individuals figure so prominently in the 'short list' that Iran insisted upon before the trade could be finalized?   Ironically, though, secretary of State John Kerry touted proudly how the USA had 'held tough' against Iran's initially bloated list of potential 'swapees', refusing to release a murderer or drug offender in order to maintain our country's 'enforcement principles', stating proudly, 'believe me, it's hard when somebody says to you, Hey, you give us this guy, we let them all out.   And you have to say no.   And you know you're keeping people in a not very nice place for the next whatever number of months...   But there have to be an enforcement of our principles and our standards here (sic).   And in the end, we came out in the right place on that.'   Oddity No. 3:   The deal is more accurately described as a trade rather than a swap because most of the individuals benefiting from the clemencies will be staying in the USA, despite the damage they've done to USA national security.   How can this be?   Why, supreme irony of ironies, it's because they're 'American citizens'.   If I were physically present in the room with you speaking those words, you'd see me using air quotes, something I usually detest, because the notion is so laughable.   And just to rub a little salt in the wounds, the lawyers for these folks are now saying it vindicates the innocence they maintained all along -- something clearly out of whack with the facts in their cases, which involved such things as setting up dummy corporations and transshipment points in foreign countries where the illegal technology and equipment transfers could take place in order to facilitate ultimate movement onward to Iran.   A few weeks ago, I blogged about Iran's objections to new [very slightly more] restrictive USA rules for the visa waiver program (VWP), in which I mentioned what was then a rumor about a pending swap, one that has now taken place and pretty much accords with my speculations that, on our end, it would involve releasing spies.   In the blog post, I surmised that Iran's major objection to the new rules was the fear that they could impede their ongoing, organized, and aggressive program to steal USA defense secrets and technology by disrupting shipments of these things out of the country, facilitated by European VWP-eligible 'dual national' intermediaries who would, under the new rules, be obliged to seek visas through consular interviews.   Nothing I have seen in this trade persuades me that I was wrong in my thinking.   I also mentioned in that post that Secretary Kerry had been making noise about the government issuing routine or blanket waivers to individuals such as these dual nationals who would otherwise be blocked from use of the VWP.   If the administration proves true to form, look to see that shoe drop, at the expense of our national interest, in the not-too-distant future."

"I last reported on the status of the Washington Alliance of Technology Workers v. U.S. Department of Homeland Security STEM OPT case here.   On 2015 August 12, the DC district vacated the regulations put in place under [Shrub] that were designed to circumvent the H-1B quotas by allowing aliens to work on student visas instead, but stayed the vacatur until 2016 February 12, so that aliens working on STEM OPT extensions would not have to immediately leave the country.   Both parties have taken the case to the next step on 2 fronts, battling in parallel.   First, the DC district held that the STEM OPT program was within DHS authority.   WashTech appealed the district court's holding that the STEM OPT program was within DHS authority to the DC circuit back in August.   So now the case is in the DC circuit in the briefing processes before oral arguments and a decision.   DHS is scheduled to file a response on January 20 as the next step in that process, but has filed an unopposed motion for an extension until January 27 that will likely be granted.   If Washtech is successful on appeal, DHS would not be able to put in place a regulation to replace the one being vacated.   In addition, the entire OPT program would likely go away.   Second, DHS used the 6-month grace period the court gave it to try to put in place a new regulation by February 12 to replace the one being vacated.   The agency published a proposed regulation, but [will not able to complete all of the required steps] to get a final regulation in place by February 12...."

"When academics are faced with criticism, one way for them to respond is to carefully explain why they believe the criticisms are invalid.   Another option is to pretend the criticism does not exist.   Economists Giovanni Peri and Vasil Yasenov chose the latter approach in today's Wall Street Journal.   By ignoring counter-arguments, they have further obscured the debate over immigration and wages.   Some quick background is in order here.   Peri and Yasenov are involved in a debate over an historical event called the 'Mariel boat-lift'.   During the summer of 1980, some 125K Cubans left [or were sent from Cuban prisons via] the port of Mariel for Miami.   This large and unexpected wave of newcomers created an intriguing test of how immigration affects wages.   Surprisingly, economist David Card was unable to detect any wage impact in his classic study from 1990, and that result has since become a favorite citation for those who want to expand immigration.   Last Fall, however, George Borjas re-analyzed the data and found that the boatlift did have a large negative impact on native high-school drop-outs in Miami.   Borjas's study was quickly followed by a rebuttal paper from Peri and Yasenov.   Then Borjas filed a counter-rebuttal.   To help make sense of all of this, I wrote an article for Real Clear Policy that summarizes the debate in plain English.   CIS then published an expanded version as a backgrounder.   I struck a neutral tone in both pieces, always giving Peri and Yasenov the benefit of the doubt despite our political differences.   But Peri and Yasenov are becoming increasingly difficult to defend.   Their WSJ op-ed not only includes a false statement, it also ignores Borjas's entire rebuttal.   How can the general public ever hope to understand an issue when academics talk past each other?   Peri and Yasenov's false statement is this one: '[Borjas's] sample consisted of only 17 to 24 workers in Miami in each year, a number too small for statistical significance.'   The negative wage effect observed by Borjas is statistically significant, meaning unlikely to have occurred by chance.   In fact, Borjas found statistically significant effects with two different datasets -- in the smaller one mentioned by Peri and Yasenov, and also in a sample about three times larger.   Peri and Yasenov also make an interesting claim at the end of their op-ed: 'Earlier research by one of us [Peri] has shown that native workers do not suffer the negative impact of arriving immigrants because they take different jobs.'   There is a relevant back story here.   Peri initially published a result that implied immigrants and natives with the same education are not 'substitutes' for each other, meaning they do not compete for the same jobs [and implicitly assuming that there are no other effects including no indirect effects].   But Peri had to retract that result when critics discovered he had accidentally included high school kids with part-time jobs as 'drop-outs'.   In the revised paper, Peri found only minor departures from the normal assumption that immigrants and natives with the same education are substitutes.   So the first error was fixed, but, as Borjas notes, it inexplicably resurfaced in Peri's Mariel paper, where he again counts high school kids with part-time jobs as 'drop-outs'.   The op-ed gives no explanation for this.   In fact, as noted above, Borjas's entire rebuttal is left unmentioned.   I will not try to rehash the entire debate here -- see my backgrounder for a detailed discussion -- but Borjas points out significant problems with broadening the sample the way Peri and Yasenov do, even aside from the issue of labeling high school kids as drop-outs..."

"A long-awaited report from the Department of Homeland Security (DHS) confirms that [visa] over-stays are a significant source of illegal immigration.   The report identified just over 527K foreign visitors who apparently did not depart as required when their authorized stay expired in 2015.   Approximately 484K were presumed to be still in the USA at the end of 2015, and 416,500 had not departed as of 2016 January 4.   Of these over-staying visitors, 43% had entered on a business or tourist visa, 29% had entered under the controversial visa waiver program (VWP), and 28% had entered from Canada or Mexico... [and, of course, some could have left the USA without that fact being recorded in the DHS data-bases]...   This sub-set of 45M admissions is only a fraction of the total non-immigrant admissions to the United States in 2015 by air, sea, and land for all purposes.   DHS did not examine the records of visitors who entered by land, which is more than three-quarters of all admissions to the United States.   Nor did it track the records of visitors granted visas for purposes other than business or pleasure, such as students, guest-workers or exchange visitors.   These categories represent a much smaller share of all annual arrivals, but still account for several million admissions per year..."

"This is a story about marriage fraud squared, about it threatening to reach from one generation to the next.     I am leaving out the names and places in this account because they are not significant to the narrative, but real people are involved, and one of them has reached out to the Center seeking assistance and advice.     In a nut-shell: Mr. and Mrs. A, both Muslims, were married for years and had 3 children in the USA.   At this point, all 5 family members are USA citizens.   Enter Mr. B, another Muslim from the home country.   He knows Mr. and Mrs. A.   Mr. B arrived with neither a long-term non-immigrant visa or a green card, something he wants very much.   Mr. B then marries Ms. C, a USA citizen, a friend to Mrs. A, and a non-Muslim, apparently so that the new Mrs. B could sponsor his green card, but that marriage broke up before the green card could happen.   Mr. B seems to have secured a short-term employment authorization as a conditional resident out of that marriage.   (Many of the details are murky because the players did not all disclose everything to everybody, and we are hearing only one side of the story.)     Mr. B had a wife in the old country and says that he and that Mrs. B got a divorce before he came here.   There may be some doubt about the legitimacy of that divorce, which might bring up the question of whether a divorce under Shariah law (the male simply announces that they are divorced) would be recognized by our systems.   (There is a document stating that the B-B divorce was recorded by a government agency in the home country.)     Then Mr. B lured Mrs. A away from her marriage, the As got divorced in the USA, and Mr. B (now on his third marriage) wed the former Mrs. A.   (This took place less than a month after the B-C divorce was final.)   Mr. A thinks that this is another marriage ploy designed to secure that green card.   B works in a retail business with the new Mrs. B's brother.   I suspect, from all I have heard, that Mr. B now probably has the conditional resident status of a newlywed alien, but not yet a green card.   The new Mrs. B has custody of the 3 A children, one of whom is an adolescent male, turning 16 shortly.   One of Mr. A's worries is that the 16-year-old, let's call him D, will perhaps be talked into (or coerced into) marrying a daughter of Mr. B's from that first marriage.   That daughter (called E here), now back in the home country, would become a legal conditional resident if she were to marry a citizen.   Since D is the child of Mr. A and the current Mrs. B, and since E is the child of Mr. B and some other woman, D and E are step-siblings.   Both of them now have a relationship with Mr. B, who is now D's step-father.   So we return to the question: Could E get a green card by marrying her stepbrother, D?     Yes, it could happen, because in the state where they all live (and in many others) there is no legal bar to step-siblings marrying, as there is for siblings or half siblings marrying.   But, as you might expect, there are some caveats.   (I am assuming that E is 18 or older, is unmarried, and living in the home country.)   In their state, as in many, you can marry at 16 with your parents' permission, and you can marry at 18 with no permission needed, so Mr. A could block the marriage, but only for a while.   Then there is the federal requirement that the alien and the citizen must have met before immigration papers will be approved, but that could be arranged by having either D or E do a bit of traveling.   Mr. A has had no luck in getting our immigration authorities to do anything about any of this beyond sending him bland responses to his pleas for legal action, and he may, in a couple of years, be in the odd situation where he is witnessing what he would regard as marriage fraud in his family occurring in 2 generations.   I suspect that Mr. A has limited options.   If he cannot talk his son out of being coerced into the proposed marriage with E, he can, as a parent, block it for a while.   Further, Mr. A might be able to go to the local prosecutor's office and seek bigamy charges against B, but that would mean the prosecutors were comfortable with challenging the validity of a divorce in another nation, while at the same time accepting the legitimacy of the original B-B marriage.   Mr. A might also petition for a re-hearing in divorce court to seek custody of his children.   Meanwhile, he does not have a lawyer to help him with these matters and may not be able to pay for one, if he could find one.   I feel sorry for Mr. A, but am aware that I am only hearing his side of the story.   From a distance I see this as both a sad, human drama, and as a highly specialized case of probably illegal chain migration."

The economy, and job markets in particular, have been weak since at least the last 2 years of the Reagan administration.   Job markets repeatedly worsened due to legislation and regulation changes beginning in Carter's last year, and about every other year since then.   In particular, the flood of cheap, young, pliant, low-skilled labor with questionable ethics has been repeatedly worsened, holding down internship and employment opportunities, facilitating transfer of intellectual property and research methods off-shore, directly displacing USA citizen workers, indirectly displacing and barring USA citizen workers from entry and upward mobility; reducing employers' willingness to invest in print advertising of jobs and to include contact information in advertisements, reducing employers' willingness to interview USA citizen job candidates, reducing their willingness to invest in new-hire and retained employee training, reducing their willingness to invest in retention and relocation of USA citizen workers...   At first only those directly harmed became aware of direct effects.   Gradually they became aware of indirect effects.   Eventually, they got through to close colleagues, relatives, and friends what had been being done for quite some time.   Years later, during the Shrub regime, it finally became a steady topic on at least one cable news program (whose viewership went from 400K to 1.4M), which caused other news media to cover it at least occasionally for a time.   Those negatively affected realized they were not alone, that it was not due to some peculiar fault of their own or a single employer.   Eventually, analysts acknowledged that millions of USA citizens had been harmed.   The "elites", who directly benefit from these changes (at least initially) have spent millions for traditional lobbying and through direct ownership of media have striven mightily every election cycle to continue to make USA job markets ever more dysfunctional.   IOW, the "elites" have been very responsive, but in ways they expect and are likely to only benefit themselves, while spreading harm throughout the USA economy.   The economic arguments related to border security, illegal aliens, student, internship, exchange, guest-work visas, and legal permanent resident/green card/immigration visas have never been able, and usually have not attempted to consider all of the relevant factors.   GNP, GDP, NIPA conflate good with bad, positive with negative effects on the economy; a higher GDP can coincide with worse economic well-being for the bulk of the population.   But there are advocates of sensible restrictions on visa from both the left and the right.   This cluster of issues does not neatly sort itself into Republican and Democrat dichotomy.   Ramesh Ponnuru's past columns clearly show that he is firmly on the side of over-population, over-crowding, low border security, little effort to find or remove illegal aliens, ever more student, exchange, internship, guest-work and immigrant visas, and low or no standards for those visas..and that he won't let facts to the contrary get in his way, nor the way of his sponsors.

"...Since last September when the Palestinians began their current terrorist onslaught, killers like Adais have been characterized as lone wolves.   But a study published last November in Mosaic on-line journal by Shalem College's Daniel Polisar shows that this characterization is both wrong and unhelpful.   Polisar studied Palestinian public opinion data from surveys conducted by 4 independent research groups over the past 25 years.   His data exposed three key aspects to Palestinian positions about Israel that all bear directly on the current Palestinian terrorist offensive.   His first finding is that throughout most of the past quarter-century a solid majority of Palestinians have supported terrorism against Israelis.   Moreover, the more murderous an attack, the more it is supported.   Polisar's second finding was that the vast majority of Palestinians hate Israelis and believe that Jews have no right to the Land of Israel, and therefore our state has no right to exist.   Taken together, these first 2 insights lead to 1 clear conclusion about the nature of the current Palestinian terrorism campaign against Israelis.   As Polisar explained, they show that this campaign is not being carried out by 'lone wolves', who have been incited by Palestinian Authority propaganda.   Rather, that propaganda reflects the murderous hatred that the vast majority of Palestinians feel toward Israelis and Israel..."

"Each approaching blizzard brings warnings about the dangers of shoveling snow, an activity that sends thousands of Americans to emergency rooms each winter.   Don't tackle the walk-way if you aren't in good enough shape...   At the gym, he noted, it's easy to hop off a tread-mill when you start feeling winded or to slip out of that spin class early.   But shoveling snow tends to be a 'goal-oriented' activity.   Call it pride, stubbornness or maybe naivete, but men especially tend to keep at it until the job is finished -- or, too often, until disaster strikes...   In a study several years ago, for example, researchers at Nationwide Children's Hospital in Ohio found that an average of 11,500 snow-shoveling-related injuries and medical emergencies occur annually in the United States.   More than half involve soft-tissue injuries, as well as lacerations, bone fractures and harm from slips and falls.   Cardiac-related injuries account for fewer than 10% of the total cases, but between 1990 and 2006, they comprised more than half of the hospitalizations and all of the more than 1,600 deaths.   The researchers also found that people over 55 were more than four times as likely as younger patients to experience heart-related problems while shoveling snow.   Men were twice as likely as women to experience symptoms..."
