I don't usually respond to each and every e-mail [message] about my Backgrounders or blogs, good or bad -- and I'm not about to start -- but, on the other hand, I'm not letting this one get by... you have misstated the statistic you cite so disapprovingly ('92% of Mexican asylum seekers pass the credible threat test'). Please note, for future reference and the sake of accuracy, that it is not a 'credible threat' test, it is a 'credible fear test'. There is no such thing as a 'credible threat test' [in this context]. Second, look at the second bullet under 'Key Findings', right at the front of the Backgrounder: the article indicates that 92% of asylum seekers pass the 'credible fear test'. There is no mention of Mexicans, or of any other nationality, because the statistic relates to all asylum seekers without regard to citizenship... the 92% statistic...was derived by the Committee on the Judiciary of the House of Representatives, based on a careful examination of data received from the agency that conducts those 'credible fear tests': USA Citizenship and Immigration Services... The 'credible fear test' process was developed and embedded into statute by law-makers who thought they were creating a mechanism for separating the wheat from the chaff where asylum is concerned. The idea was that by winnowing out the frivolous claims via such a 'credible fear test', asylum officers and judges would then be able to spend more quality time hearing and adjudicating the merit-worthy cases... Almost no asylum applicant these days, no matter how frivolous the claim appears, is placed into immigration detention. Thus, when his or her case goes to immigration court, even if the judge denies the asylum claim and orders removal, the individual isn't even there to immediately taken into custody. (In fact, many of the orders are made in absentia because the alien has long since fled, not really caring what the outcome is because he or she achieved what he or she wanted, which was a free pass into the interior.) Thus it is careless in the extreme to conflate an order of deportation with actual deportation..., which is the physical removal of the alien to his or her country of nationality. It's the difference between being sentenced to prison and actually going to prison. If you're a fugitive, then you're not in prison, no matter what the judge sentenced. The same is true for orders of removal vs. actual, physical removal. The unfortunately reality is that there are at present nearly a million aliens on the streets of the United States who have outstanding orders of removal that haven't been executed, the vast majority of them because the aliens have absconded from proceedings..."

"My colleague David North has written about Donald Trump's recent statement linking the importance of enforcing immigration laws against both illegal border crossers ('entrants without inspection' or EWIs) and visa abusers. Because the emphasis on visa violators (often just called 'over-stays', though there are other ways to violate visa rules than just over-staying) is new... In my view, it is much more likely Trump was simply following advice from his immigration advisers, many of whom are quite well versed in immigration enforcement matters, including the troubling fact that nearly half of all aliens in the USA today originally entered legally with visas or border crossing cards, or via the visa waiver program, and then simply chose to stay. This more benign interpretation of Trump's remarks would also be consistent with his promise to triple the Immigration and Customs Enforcement (USA ICE) interior enforcement officer corps, out of recognition that not only do all of these visa abusers live in the interior of the United States -- but so do the aliens who manage to evade the Border Patrol's grasp when illegally entering. In other words, it shows an increasing sophistication in understanding where and how enforcement our nation's immigration laws needs shored up. But it's also worth pointing out that it would be a mistake to equate Mexican immigration violators solely with EWIs, because of the issuance of millions of border crossing cards (BCCs), and a prior iteration of these cards known as 'laser visas' that are still in circulation. BCCs are issued to Mexican nationals, usually those who live in relative proximity to the physical border with the United States, who enter our country frequently to shop or conduct brief cross-border business affairs. BCCs are unique to Mexico. They were created as a way to save time and effort for American consular officers and port inspectors on for 'trustworthy' Mexican repeat visitors to the USA. (Canadian citizens have near unfettered rights to enter the United States provided they don't unlawfully take jobs or commit crimes, and leave in a timely manner, because their economy is on parity with ours, and immigration violator rates have historically always been low.) The BCCs function(ed) as the equivalent of a multiple-entry visa, although BCC holders were limited to a 72-hour stay within 25 miles of the border, and issuance was very strictly controlled. But, like all other things immigration-related, the rules have changed under this administration. First, came the change to the 72-hour rule. BCCs now permit entrants 30 days admission to the USA. The 25-mile proximity to the border rule has also been changed and replaced with a bewildering tangle of geographical variations. What's more, issuance of the BCCs by consular officers has become much more relaxed, no doubt as the result of the president's little-remarked 'executive action' on upping the number of overall visas issued worldwide, embedded in Executive Order (EO) 13597, 'Establishing Visa and Foreign Visitor Processing Goals and the Task Force on Travel and Competitiveness'. The consequence of these cumulative changes has been a dramatic increase in the issuance of BCCs. Take a look at the 'B1/B2/BCC' and 'B1/B2/BCV' categories in the Department of State (DoS) 2014 annual statistical report for visas: in 2010, DoS officers issued 563,494 BCCs; by 2014 that figure had more than doubled, to 1,200,413 in a single year. The loosening of the built-in control mechanisms to ensure that the holders of border crossing cards don't violate status or over-stay once admitted has taken place amidst the back-drop of a calamitous decline in immigration enforcement, both at the border and in the interior. What's more, according to a GAO report in 2007, port inspectors reported that the rate of fraud and imposture among BCCs was both exceedingly high and difficult to detect. There is no reason at all to believe this circumstance has changed. For all of these reasons, it seems pretty clear Mexican citizens are no longer reduced primarily to the indignity of being forced to cross the border illegally if they wish to enter the United States. Instead, an unknown but very sizable number have no doubt joined the teeming global community of visa abusers residing in the USA, courtesy of the loose new border crossing card rules and EO 13597's insistence on opening up the visa-issuance flood-gates. In sum, and to go back to North's blog: While I have a great deal of respect for North's expertise in all things immigration, in this instance I don't believe that there was any particular election strategy of softening unveiled by Trump's remarks. Mexicans will as surely as any other nationality be affected by a renewed emphasis on locating and arresting visa violators."

"In a CIS Backgrounder released last week, I showed that low-skill Americans have been dropping out of the labor force even as low-skill immigrants have been finding plenty of work. For example, while natives fell from 56% of the nation's high school dropouts to 52%, their share of the labor performed by all dropouts declined much faster -- from 50% in the 2003-2005 period to 40% in 2012-2015... immigration has been a crutch, or band-aid, that allows politicians and businessmen to ignore the growing problem [of wasted talent]... In 1962, about 45% of prime-age men were high school drop-outs. Those dropouts were obviously much closer to the average American in terms of skills than dropouts are today. That's why I elected not to divide the labor force trends by education in the study's Figure 1, which covers the 1962-2015 period. I started doing the education break-downs in 1994 for labor-force participation, and in 2003 for total work time. Has creaming had a major influence on the drop-out category over these much shorter time periods? That's less plausible... prime-age, native-born men between 2000 and 2015. Among high school dropouts in that group, the percentage not in the labor force (NILF) increased from 26% to 35%. However, by 2015 there were about 800K fewer drop-outs -- presumably people who graduated high school instead... Native-born men have been gradually working less for decades now... Inevitably, no matter how we divide up the skill categories, and no matter how many stories we tell about movement between categories, the picture is getting worse rather than better... political pressure on 'failing' schools has resulted in relaxed graduation standards, and it is unclear that graduation actually imparts additional skills to the people who would have been drop-outs 15 years ago. Fordham's Robert Pondiscio calls the rise in high school graduation 'the phoniest statistic in education' -- not because the trend is made up, but because the diplomas are so meaningless for marginal graduates: 'Regarding the recent spike in graduation rates, good luck figuring out what it stands for. Not improved student proficiency, certainly. There has been no equally dramatic spike in SAT scores. Don't look for a parallel uptick on 17-year-old NAEP, better performance on AP tests, or the ACT, either. You won't find it. The only thing that appears to be rising is the number of students in need of remedial math and English in college. And the number of press releases bragging about huge increases in graduation rates.'... High school completion for native-born, prime-age, black men increased from 87% to 91% from 2000 to 2015, but the black NILF rate rose from 16% to 22% over the same period... More broadly, why should we assume that natives can increase their skills in response to immigration [when they do not have additional resources to add to their skills, and employers are much less willing than in the past to invest in training and relocation]?..."

"Two House bills, each carrying some useful reforms and dealing separately with the H-1B (foreign worker) and EB-5 (immigrant investor) programs, stalled in mid-flight this week. Both bills were scheduled for mark-up (detailed committee consideration) on Wednesday and both markups were postponed by the leadership of the House Judiciary Committee. As of this writing the markups have not yet been re-scheduled. A postponed mark-up, or floor vote, usually means that the leadership is having trouble rounding up the votes needed to move along the proposed legislation; such delays sometimes lead to revisions in the proposed bills that are substantive enough to secure the needed backing. This probably is what is happening with these two bills, but there may be other factors as well. EB-5. As we reported earlier this week, HR5992 called for much more restricted use of investors' money in the future, targeting it to depressed areas, rural and urban. The language of the bill was such that one industry commentator wrote that it would effectively terminate the use of EB-5 moneys in downtown urban areas. Critics of the program have long pointed out that too much of the EB-5 money was going into luxury real estate projects in glitzy downtown areas of New York, Los Angeles, Las Vegas, and Miami, when the intent of the original legislation was to use the aliens' money to prop up the economy in distressed locations. The authors of the reform bill, Judiciary Committee Chairman Bob Goodlatte (R-VA), and ranking member John Conyers (D-MI), saw to it that the areas where these projects can be built, called Targeted Employment Areas (TEAs), were defined more narrowly... H-1B. You might think that requiring a minimum wage of $100K for foreign workers in this program -- as HR5801 does, seemingly making the alien workers more expensive to employers who thus might choose instead to hire equally [able and willing USA] workers -- would be a sure winner with representatives of the USA workers. Not so. There are 2 reasons for this: First, wages [and cost-of-living] are pretty high by mid-America standards in Sili Valley, and secondly, the professional group IEEE-USA has argued that the provision could be manipulated by the always-creative employers of H-1B workers to nullify its meaning..."
