"Every Bill which shall have passed the House of Representatives and the senate, shall, before it become a Law, be presented to the president of the United States; if he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it.   If after such Reconsideration two-thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two-thirds of that House, it shall become a Law.   But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively.   If any Bill shall not be returned by the president within 10 days (Sundays excepted) after it shall have been presented to him, the same shall be a Law, in like Manner as if he had signed it, unless the congress by their Adjournment prevent its Return, in which Case it shall not be a Law." --- article 1 section 7 paragraph 2

"Michelle Malkin and I have written a new book, _Sold Out: How High-Tech Billionaires & BiPartisan BeltWay CarpWeasels Are [Destroying the Lives, Families, and Careers of the USA's] Best & Brightest Workers_.   Among much else we cover the I-Squared Act, S153, (short for the 'Immigration Innovation Act of 2015').   If you are an American worker, that bill is more appropriately called the 'I'm Screwed Act'.   But there was so much other ground to cover, our book does not go into the bill's provisions in detail.   Therefore, I thought I would take the time to do that here.   But first, some background on the book.   We were fortunate to have good timing, with the book coming out after the media has partially lifted its black-out on reporting the politically incorrect fact that employers use foreign workers to replace Americans.   It took months from the time ComputerWorld and a local TV station reported that Americans were replaced by H-1B workers at Walt Disney World to the time it was first reported in the New York Times.   As I previously pointed out, the local newspaper, the Orlando Sentinel, reported on the Disney lay-offs but, in a case of political correctness run wild, failed to report the fact that foreign workers were replacing those losing their jobs.   While we have reached the first step of getting some in the media to look at the issue, there is still a long way to go toward educating the media.   When it comes to H-1B, the main-stream media has not gotten beyond the talking points, and is still reporting non-sense...   The H-1B program was designed for employers to replace Americans with cheap foreign workers and to allow employers to abuse the system with impunity.   In the space of a book, Michelle and I are able to go into the actual legislation to show how this was deliberately done.   Politicians may say one thing, but they do another.   We have a good example of that from the man who set the record for going native faster than anyone else after coming to Washington: Marco Rubio.   In action, senator Rubio has become a steadfast supporter of replacing Americans with foreign workers.   Now that the Disney story has blown up in his face, Rubio has been talking differently from how he has acted.   Rubio now says that there ought to be protections for American workers in the H-1B program..."

"...The [proposed] legislation is a direct amendment to current U.S.A. laws already on the books that give preference to oppressed minorities and that was used by president Ronald Reagan to alleviate the plight of Soviet Jews and other religious minorities.   Please join us in demanding an end to this dangerous folly by signing our open letter to House and senate Republican [losers].   Conservatives warn that the amendment would facilitate an unprecedented right to immigration that has never existed under U.S.A. law.   Our friends at The Washington Free Beacon reported that 'This amendment will establish the progressive goal of creating a right to global migration, their solution to global income inequality.', according to one Capitol Hill source.   'This is not simply a slippery slope.   This is ripping open Pandora's box.   If you can establish that we have no right to consider religious beliefs, then you could help establish we have no right to consider a candidate's age, skill, income, or country of origin.'   If passed, the new rule would burden the U.S.A. immigration system and prevent authorities from normal background checks meant to ensure individuals are not tied to terrorists or other type of criminal enterprises, the Capitol Hill source told the Free Beacon.   'It would could lead to rules saying you can't discriminate against foreign single mothers, or unemployed elderly seniors, or members of religious cults.   And if religion cannot be considered, then of course you cannot favor say Australian immigration over Middle East immigration since religion is, of course, a factor in that decision.', the congressional source explained.   'It would mean you could not favor a Christian Syrian priest over a fundamentalist Muslim cleric, and that if you denied the cleric you'd be paving the road to them having standing to sue for entry from a foreign country.'   Only 4 Republicans: senators Jeff Sessions (R-AL), Ted Cruz (R-TX), David Vitter (R-LA) and Thom Tillis (R-NC) opposed the [vile] Leahy amendment...   Our immigration system derives exclusively from Article 1, section 8, clause 4 of the USA Constitution, which vests the exclusive power in the Congress to establish a uniform system of immigration.   Through acts of congress, the USA can -- and does -- exclude aliens from entry into the USA for any reason provided by congress.   The rules governing the selection of immigrants are, by definition, opposite the rules governing the treatment of citizens living or naturalized in the USA.   There are 7G people in the world.   Choosing who can immigrate into the United States is, by definition, an exclusionary process.   The goal is to select immigrants for admission based on the benefits they provide to society based on skills, ages, values, philosophy, incomes, etc.   Our goal is to choose for admission those likeliest to succeed and flourish and, crucially, to support our Constitutional system of government and our values of pluralism and republican governance.   So whereas we consider it improper to deny employment to a U.S.A. citizen based on, say, their age, we consider it necessary and important to consider immigrants according to their age and whether they will be able to contribute productive years of work to American society.   As stated by the United States supreme court, 'Whatever the procedure authorized by congress is, it is due process as far as an alien denied entry is concerned.'..."

"[Oath-breaking, race-obsessed, anti-USA, anti-constitution president Barack Hussein Obummer] claims that restricting immigration in order to protect national security is 'offensive and contrary to American values'.   No-limits liberals have attacked common-sense proposals for heightened visa scrutiny, profiling or immigration slowdowns as 'un-American'.   America's Founding Fathers, I submit, would vehemently disagree.   Our founders, as I've reminded readers repeatedly over the years, asserted their concerns publicly and routinely about the effects of indiscriminate mass immigration.   They made it clear that the purpose of allowing foreigners into our fledgling nation was not to recruit millions of new voters or to secure permanent ruling majorities for their political parties.   It was to preserve, protect and enhance the republic they put their lives on the line to establish.   In a 1790 House debate on naturalization, James Madison opined:   'It is no doubt very desirable that we should hold out as many inducements as possible for the worthy part of mankind to come and settle amongst us, and throw their fortunes into a common lot with ours.   But why is this desirable?'   No, not because 'diversity' is our greatest value.   No, not because Big Business needed cheap labor.   And no, Madison asserted, 'Not merely to swell the catalogue of people.   No, sir, it is to increase the wealth and strength of the community; and those who acquire the rights of citizenship, without adding to the strength or wealth of the community are not the people we are in want of.'   Madison argued plainly that [the USA] should welcome the immigrant who could assimilate, but exclude the immigrant who could not readily 'incorporate himself into our society'.   George Washington, in a letter to John Adams, similarly emphasized that immigrants should be absorbed into American life so that 'by an intermixture with our people, they, or their descendants, get assimilated to our customs, measures, laws: in a word soon become one people'.   Alexander Hamilton, relevant as ever today, wrote in 1802: 'The safety of a republic depends essentially on the energy of a common national sentiment; on a uniformity of principles and habits; on the exemption of the citizens from foreign bias and prejudice; and on that love of country which will almost invariably be found to be closely connected with birth, education and family.'   Hamilton further warned that 'The United States have already felt the evils of incorporating a large number of foreigners into their national mass; by promoting in different classes different predilections in favor of particular foreign nations, and antipathies against others, it has served very much to divide the community and to distract our councils.   It has been often likely to compromise the interests of our own country in favor of another.'   He predicted, correctly, that 'The permanent effect of such a policy will be, that in times of great public danger there will be always a numerous body of men, of whom there may be just grounds of distrust; the suspicion alone will weaken the strength of the nation, but their force may be actually employed in assisting an invader.'   The survival of the American republic, Hamilton maintained, depends upon 'the preservation of a national spirit and a national character'.   He asserted, 'To admit foreigners indiscriminately to the rights of citizens the moment they put foot in our country would be nothing less than to admit the Grecian horse into the citadel of our liberty and sovereignty.'..."

"...Government statistics show that 'hate crimes' are directed much more frequently against Jews, the target of prejudice throughout the ages, than against Muslims.   Both presidents showed a lack of confidence in the ability of ordinary Americans to carry in their heads two ideas seemingly in tension.   One is that most violent terrorists these days are Muslims (our 'leaders' may claim that they aren't true believers in Islam, but the terrorists obviously don't agree).   The other is that most Muslims aren't terrorists.   But it turns out that ordinary people are entirely capable of understanding that not everyone in a certain category behaves according to stereotypes, even those based on statistical facts.   This is not actually a difficult concept.   Fans know that most professional basketball players are black, but that nonetheless some whites are better players than some blacks.   There was another objectionable aspect to [Obummer's] Sunday night speech.   'It is our responsibility to reject religious tests on who we admit into this country.', he said.   That was a partisan slap at Republicans who suggested that priority in admitting Syrian refugees should be given to non-Muslims.   But no nation is under an obligation to admit foreigners to its territory, and the U.S. Constitution prohibits a 'religious test' only for public officials.   American asylum law provides preferences for those persecuted for their religious beliefs, as Yazidis and Christians have been by Islamic State forces.   For many years American law provided for special treatment for Soviet Jews.   Religious tests, in appropriate circumstances, are entirely consistent with American tradition and humanitarian principles... This seems to me to get recent history wrong. 'If this guy doesn't look like an Arab terrorist, then nothing does', the ticket agent who let 2001/09/11 hijacker Mohamed Atta pass through security recalled thinking, 'but it's not nice to say things like this.'   Neighbors of the San Bernardino terrorists noticed peculiar goings-on but didn't report them to authorities..."

"In sharp contrast to the Grassley-Durbin bill calling for some useful modifications of the H-1B program, senators Ted Cruz (R-TX) and Jeff Sessions (R-AL) have introduced legislation that would just about terminate the H-1B worker program, as they announced in a press release.   This is the most sweeping anti-H-1B legislation to be introduced into congress in my memory.   Sessions, chair of the senate's immigration subcommittee, has long been opposed to the H-1B program because it denies jobs to some U.S.A. workers and reduces wages for many others.   Cruz, now a candidate for president, was, until recently, a champion of expanding the program.   In fact, during the 2013 debate on the Gang of 8's [reprehensible immigration law perversion bill, Cruz, at the committee level, introduced a failed amendment that would have boosted the ceilings on new H-1B admissions from 85K to 325K, as I reported at the time.   The Cruz-Sessions bill is in harmony with the Texas senator's overall current immigration policy, hailed as 'imperfect but a big step forward' by Mark Krikorian in a posting last month.   The Cruz-Sessions legislation, the American Jobs First Act of 2015 (S2394), would set a minimum wage of $110K per year for new H-1Bs, which would seriously dampen employers' interest in the program, as they usually pay much less than that for their H-1B workers, usually young college grads from India and [Red China.   (See the bill's text here.)   It would also force employers to observe a 730-day 'cooling off' period before they could use the H-1B program to replace laid-off, furloughed, or striking U.S.A. workers.   And it would simply end the Optional Practical Training (OPT) program, another foreign-worker program involving recent alien college grads, a program that often dovetailed with H-1B.   (There is no training involved in OPT, it is just a program for inexpensive foreign workers, with their employers being excused from paying pay-roll taxes when they hire these alien workers.)   The bill would also repeal the Diversity Visa Lottery, which grants green cards to about 50K randomly selected people from any country not among the top sending countries.   (The top beneficiaries in 2014 were Nepal, Egypt, and Uzbekistan, with more than 3K green cards each.)   In contrast to the black-and-white Cruz-Sessions legislation, the Grassley-Durbin legislation is sketched in varying shades of grey, as we outlined in 3 earlier postings, starting with this one.   The Grassley-Durbin proposal would make a series of modest improvements in both the H-1B program and in the somewhat similar L-1 program (for employees of multi-national firms working in the United States)."
