DHS has filed a last-ditch motion to preserve improper extension of OPT terms to 29 months
"As we have reported previously, the U.S. District Court for the District of Columbia vacated new regulations for the Optional Practical Training (OPT) program effective 2016 February 12.   The court gave DHS a 6-month delay to allow it to take some form of corrective action.   The deadline for DHS to correct by getting a new rule in place has come and gone.   (OPT is for foreign workers masquerading as students; the new regulations extend the period of time foreign graduates in STEM fields (Science, Technology, Engineering, and Math) could work under PT status.)   As DHS pointed out to the court, once the rule is vacated on February 12, aliens working on the OPT extensions will have to cease work and leave the country.   We now know how DHS will respond to its failure to meet the deadline.   It filed a motion last week with the District Court to seek relief from the judgment, hoping to get a further delay on the vacatur of the regulation.   This is a Hail Mary on the part of DHS; the Cowboys have better odds on making the Super Bowl this year than such a motion has to succeed.   The motion process will extend into the middle of January.   Depending on how long it takes the judge to decide, the foreign guest workers will get less than a months' notice whether they can continue working past February 12.   In fact, they may get no notice at all.   February 12 could come with no court decision and they would have to immediately stop working.   DHS could have used the 6-month delay the court very generously granted them to plan an orderly transition for when the OPT extensions go away, but did not do so.   If this sounds screwed up, remember that these are the same folks managing airport line security.   'Nuf said.   I found the materials DHS filed in support of the motion highly disturbing.   Remember that OPT extensions were created in 2008 for the purpose of circumventing the quotas on H-1B visas; the thinking was, if the aliens could not get an H-1B visa, let them work on a student visa instead after graduation -- even though they were no longer students.   MSFT pitched the idea of these regulations to the DHS secretary at a dinner party.   DHS then worked in secrecy with industry and academic lobbyists to create the rules and promulgated them [contrary to current laws] without any notice to the public that such rules were being considered.   That, folks, is government corruption.   When the court held last August that the regulations were promulgated unlawfully, what was DHS's response to having a court-imposed deadline?   In the motion, Rachel Canty, Assistant Director for External Operations for the Student and Exchange Visitor Program (SEVP) at U.S. Immigration and Customs Enforcement (US ICE), said DHS took an 'all-hands-on-deck approach, in which multiple offices from throughout DHS and other agencies helped develop and review the draft regulation on an expedited basis'.   Hmmmmm.   Compare and contrast: When Americans are replaced by H-1B workers, DHS does absolutely nothing.   Zero.   When foreign workers will lose their jobs, DHS summons 'all-hands-on-deck' [using all available legal dodges, procedures and loop-holes] to respond.   That shows a government with a completely warped sense of priorities."

"Some would-be F-1 students from India have been shipped home, and others barred from taking flights to the USA, in what may be another visa mill scandal in California's Bay Area.   The two educational institutions involved are Silicon Valley University (SVU), and the somewhat bigger Northwestern Polytechnic University (NPU).   Both institutions are run largely by Chinese Americans, and both are largely attracting students from India -- the same basic pattern as was found a couple of years ago in the ICE-closed Tri-Valley University and in Herguan University, whose founder, owner and former CEO has been sent to jail for immigration fraud.   Tri-Valley and Herguan are also in the Bay Area.   Yet another Chinese-run, Indian-attended visa mill, the University of Northern Virginia, was closed by state authorities and subsequently de-listed by the slow-moving Student and Exchange Visitor Program (SEVP), a subset of Immigration and Customs Enforcement..."

"A bright note, if it can be called that, in the recent passage of the [omnibus over-spending bill] was that at the last moment, the 'Visa Waiver Program Improvement Act of 2015' (HR158) was folded into the government funding measure, so it too became law and the visa waiver program (VWP) was significantly tightened up.   The VWP permits nationals of participating countries to travel to the USA visa-free.   However, one of the provisions in the enacted reforms prohibits otherwise-eligible travelers who are natives of, or who have traveled to, Syria or Iraq or countries designated by the secretaries of State or Homeland Security as supporters or sponsors of terror, such as Sudan and Iran (such travel having occurred any time from 2011 March 1 onward) from participating in the VWP.   Otherwise-eligible VWP travelers who are natives of the designated countries would be individuals born in Syria, Iraq, etc., but naturalized in a country participating in the VWP.   Like those who have simply visited the proscribed countries since 2011, these travelers are now required instead to seek visas through [mere] interviews by American consular officers -- although exceptions have been carved out for VWP-eligible nationals whose travel involved service in military or civilian government capacities in the designated proscribed countries.   Given the uncertain, terrorist-stricken state of the world today -- not to mention our government's obviously imperfect [hardly trying] vetting procedures -- there are sound reasons for these new prohibitions on use of the VWP.   But Iran has formally objected to the restrictions being imposed, suggesting that they violate the recently-concluded and highly controversial [Obummer treaty to help them develop nuclear weapons and delivery systems, which treaty has not been ratified in accordance with the USA constitution's explicit requirements].   This is interesting in light of allegations that Iran itself has already egregiously violated the agreement through missile testing (which they deny, though their word is hardly bond, is it?).   The Iranian assertion that USA control over our own visa processes will somehow impede their economy is also curious.   It's difficult to comprehend how one would have much influence over the other, leading one to question exactly why Iran would care about this new national security restriction.   Those of a cynical disposition might note that Iran has an extremely comprehensive, effective, and aggressive intelligence program which expends substantial time and resources targeting USA military equipment, plans, and programs, as well as 'dual use' technology whose export is restricted.   Nearly a dozen naturalized citizens originally from Iran have been arrested, convicted, and sent to prison in recent years after stealing or attempting to steal defense or technological equipment or secrets for export to Iran.   (A partial list can be seen in the table at the end of the document found here.)   These convicted spies have been referred to as 'Iranians' and 'ours', despite their USA naturalization, by Iranian officials including new Iranian president and so-called 'moderate' Shiite cleric Hassan Rouhani.   In the world of espionage, handing off stolen materiel and other secrets is tricky business, and one of the times when spies are most vulnerable to discovery.   Continental Europe, with its freedom of travel for possessors of European Union (EU) passports, is one trans-shipment center for the military and dual technology equipment, and no doubt also for plans and technical schematics.   What better way for the USA-based foreign intelligence agent to get rid of the goods than through dead drops and brush-passes with EU-based operatives coming here via the VWP, who then take on the burden of getting them out of the USA and into Europe on their departure?   In this country, immigration and customs exit controls are nearly non-existent.   Subjecting Iranian spies who have naturalized in EU countries to a new procedure of visa interviews, background checks, and other intrusive vetting methods is the last thing the Islamic 'Republic' would want, because it risks throwing a monkey wrench into an otherwise excellent espionage system.   So what to do?   Pitch a fit, say the nuclear agreement is 'at risk', and watch what happens.   How has our government reacted?   According to The Hill, secretary of State John Kerry promptly sent a letter to Iranian foreign-minister in which he 'hinted at using special authority to waive restrictions in the new legislation'.   In its infinite wisdom, congress did indeed write such waivers into the legislation, although Kerry doesn't seem to understand that the authority belongs to the secretary of Homeland Security, not State.   But that's potayto-potahto, isn't it?   Does anyone doubt that if the president wishes it, the waivers will take place, and most likely on a routine basis, whatever congressional intent may have been?   What did they think would happen, given the history of this administration's expansive, rubber-band views of the law and the Constitution?   And does anyone doubt that the president will indeed want this outcome, given the lengths to which the [corrupt Obummer regime] has been willing to abase itself to achieve the nuclear agreement with Iran?   And, it's inevitable that congress will squawk but do little else if the waivers come thick and fast, as seems quite likely.   Isn't that the way this has gone with virtually everything immigration-related in the past several years?   It's like watching a slow-motion mud-slide of national and homeland security interests washed into the raging river of expedience and progressive group-think, and watching it all flow away.

"Measure it any way you like, but this hasn't been the championship season of the 'can do' spirit of [the USA].   Most of the presidential campaigners spend their allotted minutes criticizing what's wrong with the country, how others have made a mess of things, and why voters should put them in charge of changing things.   It's difficult to find the formula through the haze of confusion and fog of rhetoric.   There's far more blowhard nastiness than creative eloquence.   That's what politics is about, of course, but it gets tiresome in the holiday season when we're craving inspiration from our better angels, if any have survived.   If you crave a reprieve, if only for two hours (considerably shorter than a presidential primary debate), dip into the pop culture and see 'The Martian', a technologically hip, feel-good movie about what the American spirit can accomplish, if only in a sci-fi movie.   'The Martian' is set in the not-so-far future, about stranding a man on Mars and getting him back.   The movie, as you may have heard if you're in ear-shot of a sci-fi loving teenager (or adult), is about an astronaut, Mark Watney, portrayed by Matt Damon, who has been abandoned on the red planet by his crew.   They thought he was dead.   The story was lifted from a novel by Andy Weir [a USA STEM professional who started programming at age 15 (1987) at Sandia National Labs outside Albuquerque, started at UCSD in 2010], admired for its authentic scientific detail and mathematical accuracy, rooted in the challenges to the human spirit in the collective ability of man to find technological solutions to human problems.   Life is not easy for a man alone on the red planet..." donate to Jewish World Review Internet Education fund via Keren Yehoshua ve Yisroel

"Dr. Gershon Pincus, who has family in Israel, was denied a security clearance to be a Navy dentist due to his potential for 'divided loyalties'.   But HitleryRottenClinton aide Huma Abedin, whose ties to the Muslim Brotherhood are well-documented, was granted a security clearance to access the highest levels of American intelligence, some of which ended up on Clinton's un-secure e-mail server and who knows where else.   Right before Christmas an interesting national security story broke that was immediately swamped by the usual pop culture and commercial pre-Christmas news about movie openings, stars doing nice things for poor people and the usual material that fills the news when reporters are on vacation, not on the beat.   But the story of how Dr. Gershon Pincus, a successful New York dentist who closed his practice and volunteered for the Navy, only to be denied a security clearance needs to be told, especially in light of [Hitlery Rotten Clinton and Barack Hussein Obummer's] bizarre pattern of welcoming into the highest levels of government people associated with the Muslim Brotherhood and other Islamist organizations.   As part of a security clearance review, Dr. Pincus was interviewed and during the course of his interview, his family connections to Israel were discussed, including that his elderly mother and two siblings live there and that his son tragically died of a drug overdose whilst serving in the Israeli Defence Forces [IDF].   Dr. Pincus has only visited Israel 3 times in the past ten years, including one visit for his father's funeral and has no holdings in the country or an Israeli passport.   The security investigation concluded: 'There is nothing in subject's background or character that would make him vulnerable to blackmail, extortion, coercion or duress.'   However, in March, Dr. Pincus was subjected to a second interview in which all but one of the questions related to his connections to Israel.   In September, Dr. Pincus's security clearance was denied, putting a stop to his dental work.   The Statement of Reasons explained:   'You have weekly telephone contact with your mother and brother in Israel.   You added your mother, sister and brother may have contact with neighbors in Israel.   Foreign contacts and interests may be a security concern due to divided loyalties or foreign financial interests, may be manipulated or induced to help a foreign person, group, organization or government in a way that is not in USA interests, or is vulnerable to pressure or coercion by foreign interests.'   (PowerLine on Gershon Pincus)   So having a relative in Israel is a security risk due to 'divided loyalties'?   But having a mother, father and siblings involved in the Muslim Brotherhood isn't?   We've told CHQ readers about the ties to the Muslim Brotherhood Hillary Clinton's top aide, Huma Abedin has, but a quick review of those ties in light of Dr. Pincus' case and the ongoing debate over the national security threat posed by 'Syrian' 'refugees' and various other Muslim immigrants is in order.   Some observers have called the Clinton email scandal an unprecedented breach of national security, and it is important to note up front that what triggered the FBI investigation of Mrs. Clinton was an e-mail from Ms. Abedin [Mrs. Weiner] that included classified information.   Although born in the USA, Ms. Abedin spent 16 years of her youth in Saudi Arabia, where her late father Syed Abedin, worked for Abdullah Omar Naseef, a major Muslim Brotherhood figure who served as vice president of Abdulaziz University (AU), and had recruited Abedin, to work for the Institute of Muslim Minority Affairs (IMMA), a Saudi-based Islamic think tank.   Ms. Abedin's mother, Saleha is equally involved in the Muslim Brotherhood.   As our friend Andrew C. McCarthy pointed out in an article for National Review back in 2012:   'Huma Abedin's mother, Saleha, who is a member of the Muslim Brotherhood's female division (the 'Muslim Sisterhood'), is a major figure in not 1 but 2 Union for Good* components.   The first is the International Islamic Council for Dawa and Relief (IICDR).   It is banned in Israel for supporting Hamas under the auspices of the Union for Good.   Then there's the International Islamic Committee for Woman and Child (IICWC) -- an organization that Dr. Saleha Abedin has long headed.   Dr. Abedin's IICWC describes itself as part of the IICDR.   And wouldn't you know it, the IICWC charter was written by none other than...Sheikh Qaradawi, in conjunction with several self-proclaimed members of the Muslim Brotherhood.'   So, Ms. Abedin's Muslim Brotherhood pedigree is well-documented, and well known to Clinton and to other Washington insiders, such as Republican senator John McCain, who defended Abedin in a speech on the senate floor when 5 conservative Members of the House of Representatives called for the State Department Inspector General to look into Abedin's fitness to hold a high level security clearance while she served as Hillary Clinton's deputy chief of staff at the State Department.   When questions were raised about Ms. Abedin fitness to hold a high level security clearance, given her long family history of ties to the Muslim Brotherhood, senator McCain rose to call the questions regarding Ms. Abedin's family ties to the Muslim Brotherhood 'sinister accusations [that] rest solely on a few unspecified and unsubstantiated associations of members of Huma's family'.   And the 5 conservative Members of Congress were smeared in the media as Islamophobes, McCarthyites and worse.   Except, as Andy McCarthy and others have documented, Ms. Abedin's family ties to the Muslim Brotherhood aren't 'unsubstantiated', and neither is the Muslim Brotherhood's threat to constitutional government.   In 2007 July, 7 officials from a now-defunct charity known as the Holy Land Foundation (HLF for short) went on trial for supporting Hamas, the terrorist organization that represents the Palestinian branch of the Muslim Brotherhood.   The ensuing court case unearthed a number of key documents, the most important of which was a 1991 Arabic-language memorandum outlining the Brotherhood's strategic goals in the USA.   This includes the objective of:   'Enablement of Islam in North America, meaning: establishing an effective and a stable Islamic Movement led by the Muslim Brotherhood which adopts Muslims' causes domestically and globally, and which works to expand the observant Muslim base, aims at unifying and directing Muslims' efforts, presents Islam as a civilization alternative, and supports the global ISIL/ ISIS/ Daesh/ IS/ caliphate wherever it is.'   The document goes on to identify the Brotherhood's supporters in this objective, among them such groups as the Islamic Society of North America, the Islamic Association for Palestine (the precursor to what today is known as the Council on American Islamic Relations), and the multi-university umbrella organization known as the Muslim Students Association.   We know [that], just like the Communists of the twentieth century, the Muslim Brotherhood is operating in the USA -- and recruiting high level operatives such as Egypt's former anti-American president, Mohammed Morsi, (over-thrown in a popular uprising) who joined the Muslim Brotherhood after being recruited into the Muslim Students Association right here in America.   And any unbiased observer would have to admit that during [Hitlery Rotten Clinton's] tenure as [Barack Hussein Obummer's] Secretary of State the goals of the Muslim Brotherhood as disclosed in the Holy Land Foundation trial were advanced at an incredible pace.   As Andy McCarthy documented:   'Since Secretary Clinton's tenure began, with Huma Abedin serving as a top adviser, the United States has aligned itself with the Muslim Brotherhood in myriad ways.   To name just a few (the list is by no means exhaustive):   Our government reversed the policy against formal contacts with the Brotherhood; funded Hamas; continued funding Egypt even after the Brotherhood won the elections; dropped an investigation of Brotherhood organizations in the USA that were previously identified as co-conspirators in the case of the Holy Land Foundation financing Hamas; hosted Brotherhood delegations in the United States; issued a visa to a member of the Islamic Group (a designated terrorist organization) and hosted him in Washington because he is part of the Brotherhood's parliamentary coalition in Egypt; announced that Israel should go back to its indefensible 1967 borders; excluded Israel, the world's leading target of terrorism, from a counter-terrorism forum in which the State Department sought to partner with Islamist governments that do not regard attacks on Israel as terrorism; and pressured Egypt's pro-American military government to surrender power to the anti-American Muslim Brotherhood...'   Huma Abedin's role in the national security disaster that is unfolding in the Hillary Clinton e-mail scandal now begs the question 'why wasn't that IG investigation conducted?'   But the case of Dr. Pincus begs the question 'was any inquiry into whether Ms. Abedin's family ties rendered her unsuitable for a position that involved access to classified information, especially about the Muslim Brotherhood, ever conducted?'   Answering that question is of paramount urgency now that it has been revealed that Huma Abedin was at the heart of a breach of USA's most sensitive intelligence while she was Hillary Clinton's deputy chief of staff at the State Department.   All federal employees and armed forces personnel take an oath to 'support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same...'.   Can anyone who adheres to the tenets of the Muslim Brotherhood's Islamic supremacy, which seeks to impose, whether through violence or by stealth, brutally repressive, totalitarian, misogynistic, homophobic, intolerant and anti-constitutional shariah on others -- honestly swear to uphold, protect and defend the Constitution?   A security clearance and access to the highest levels of American military and diplomatic intelligence are not constitutional rights.   If Dr. Pincus was denied a security clearance to practice dentistry in the Navy, it is time for Ms. Abedin to be put under oath to answer questions about her associations with the Muslim Brotherhood, whether or not she lied during her security clearance process and her role in moving classified material from the secure State Department system to the unsecure Hillary Clinton e-mail server.     *'The Union for Good' is an umbrella organization created by Sheikh Yusuf al-Qaradawi, which is formally designated a terrorist organization under USA law.   Sheikh Qaradawi is a promoter of jihadist terror.   His fatwas endorse terrorist attacks against American personnel in Iraq as well as suicide bombing -- by both men and women -- against Israel.   He is a leading supporter of Hamas, the Muslim Brotherhood's Palestinian branch."

"According to the National Bureau of Economic Research (the [generally-accepted authority on dates of] USA recessions) the USA recession began in 2007 December and ended in 2009 June, and thus extended over 18 months.   During the Great Recession Americans saw some 40% of their wealth wiped out.   The Federal Reserve conducted a study in 2012 that showed the median net worth of families plunged by 39% in just 3 years, from $126,400 in 2007 to $77,300 in 2010.   That put Americans roughly on par with where they were in 1992, meaning some 2 decades of wealth accumulation was erased in just 18 months.   The recession was especially hard on African-Americans.   According to a study by Jeanette Wicks LIM, the typical black household in 2009 was left with less wealth than at any time since 1984, after correcting for inflation.   And that lost wealth is not being re-accumulated, or being re-accumulated at an agonizingly slow pace.   The U.S. Census Bureau reported in 2014 September that USA real (inflation adjusted) median household income was $51,939 in 2013 versus $51,759 in 2012, statistically unchanged.   In 2013, real median household income was 8% lower than in 2007, the year before the Great Recession.   Thus, 6 years after the Great Recession officially ended, for many Americans the devastation of their quality of life continues [to worsen] as they are unable to find work, their unemployment insurance long ago ran out and they join the ranks of government dependents or members of the shadow economy.   How can that be?   According to the front pages of the major newspapers and the lead segment on the TV news unemployment is down to 5% -- or what was considered to be near full employment before 2007.   Indeed in November, the number of 'unemployed persons' [unemployed and actively seeking work] was only 7.9M, and was essentially unchanged from the month before.   And most importantly, over the past 12 months, the unemployment rate and the number of unemployed persons are down by 0.8 percentage point and 1.1M, respectively.   So people were finding work and the unemployment rate is going down, right?   Wrong!   The unemployment rate is going down because workers are leaving the work-force, not because they are finding jobs. And for the over 93M workers who have left the work-force the Great Recession is by no means over as their quality of life and wealth continue to erode..."

"In 2016, battle lines will be drawn.   On one side, people of all colours, genders and orientations are rallying around the flag of freedom of speech.   On the other, a nasty set of authoritarians are rallying around a flag that identifies as a flag only on Mondays, uses they/them pronouns and will try to get you fired or expelled from school if you forget it.   Let me explain.   In 2015, I saw the seeds of a movement begin to sprout.   Across the internet, and even in fear-gripped halls on campuses, young people began to stand up and challenge the humourless, divisive, identity-obsessed elites that have taken over our cultural discourse.   People of seemingly disparate interests and politics -- gamers, pundits, metalheads, comic book and science fiction fans, atheists, Catholics, conservatives, libertarians and even many disaffected liberals -- came together to agree on only one thing: art and culture should be left alone.   That movement is called cultural libertarianism.   It stands against any authoritarian, from the Right or the Left, who sucks fun and freedom from the world like some kind of vampire without the cool factor, and who uses faux grievances and exaggerated victimhood to get what they want.   Cultural libertarianism rejects the fainting-couch feminism and race-baiting of the Left in favour of deliberately provocative joyfulness and exuberance.   It also predicates facts over hurt feelings, versus the 'social justice' crowd who want to turn harrowing anecdotes into 'lived experience' -- which we are then expected to treat like scientific data..."

"...I'm proud to say that I come in at number 6 (though obviously I would have preferred higher) with my statement that alarmist climate scientists are 'a bunch of talentless low lives who cannot be trusted'.   In retrospect I wish to apologise for that sentence.   What I really should have said is that these are a bunch of lying, cheating, scum-sucking, bottom-feeding, third-rate tosspots who don't even deserve the name 'scientists' because what they practise isn't really science but data-fiddling, cherry-picking, grant-troughing, activism-driven propaganda.   Posterity will grant them about as much respect as we now accord the 17th century quacks who bled their patients using leeches, or the early 20th century German scientists who helped Hitler compose his diatribe against the discredited Jewish science of Einstein, or the scientists who ganged up on Alfred Wegener for his novel -- but correct -- theories on continental drift.   Really, if none of them ever published another paper in their lives and all their grant funding dried up at midnight tonight, the cause of climate science would not suffer one jot -- and the world would become a much better (and richer) place..."
