"Last week one of my informants sent me an article headlined 'US: 4 Indian-Americans charged with H-1B fraud'. Since I had written a blog post a few days earlier involving 5 Indian-Americans in a case of H-1B fraud, my initial assumption was that the headline writer simply had the wrong number of culprits. It turned out, however, that the 5 earlier ones were in Virginia, while the four current ones were in California. Two completely separate cases, but with many of the same characteristics: Both centered around an Indian-American and his wife; Both involved the rent-a-programmer business ([a.k.a. cross-border boyshops]); Both involved phony, small corporations as the 'employers' of the H-1Bs; Both involved a totally or almost totally Indian work force; Both were at the fringes of the 'IT' sector; Both falsified innumerable government applications; Both were accused of not paying, as they should, H-1Bs who were benched, i.e., temporarily without an employer; and Both apparently, though this is less clear, charged the workers for obtaining the H-1B status, which is totally against the law. (This is standard in these cases.) You might say that a pattern is emerging, one that should have tipped off the authorities years before they began investigating these cases... Why don't those handling H-1B applications check the names of all the apparently small corporations with the IRS list of those paying the Federal Unemployment Tax Act (FUTA) tax; this would show all companies that have paid at least $7K to one or more workers; at the same time, check to see if the corporation has a website and/or a phone number. Further one could check the firm against the list of employers who have, as they should, taken out workers' compensation insurance. (The latter would be a state, as opposed to federal, set of records.)... unemployed citizen programmers who have lost their jobs to H-1B workers... they, or other activists, could start such process by using the myvisajobs.com website to look for suspect small firms using the cross-checks mentioned. This would not give the ex-Disney workers their jobs back, but it would help cut back on the all-too-many abuses in H-1B, and produce negative publicity for the whole program..."

"The AAF report claims only that illegal immigration has increased economic output by up to $623G. It does not show that natives get that money. In fact, the vast majority of the economic gains from immigration are captured by immigrants themselves in the form of wages, so most of the $623G that would be 'lost' currently goes to illegal immigrants [some of the rest go to remittances], not to Americans. One way to see the difference between the size of the economy and the income of natives is to imagine that every American gets cloned, and the capital stock doubles to match the larger workforce. The American economy would be twice as large as before, but Americans would still have the same per capita income. The cloning would therefore be 'good for the economy' in the sense that GDP has doubled, but the pre-existing population would be no better off. Of course, the reality of immigration is more complicated than the cloning story. Because the skill distribution of real-world immigrants (unlike clones) is different from that of natives, immigration [might possibly] generate efficiency gains. But those gains are always tiny relative to the increase in GDP. In a 2013 analysis for CIS, economist George Borjas estimated that of the hundreds of billions of dollars that illegal immigrants add to the USA economy, just 2.2% of those dollars go to natives. That would mean the 'devastating' $623G cost of deportation reported by the AAF translates into a loss for natives of somewhere around $14G, which is less than one tenth of one percent of GDP. Far more important would be the distributional, fiscal, and logistical impacts of deportation, which include a major shift of income from employers and consumers toward low-skill native workers. Confusing the size of the economy with gains for natives is a common problem, but it need not continue. Making an inquiry to an outside expert would have helped the media report fairly on the AAF study, but I cannot find a single outlet that did so. For all their professed interest in fact-checking, the media have some rather persistent and self-imposed blind spots."
