"Here's a new wrinkle in the EB-5 business: An employer got millions in EB-5 funds to run a shrimp farm and then didn't pay its workers.   Does the business get credit for creating these jobs without pay-checks?   Do the investors get their green cards anyway?   As you might imagine, answers are not readily available.   Florida Organic Aquaculture, a for-profit enterprise, is a 22-acre shrimp farm in Fellsmere, FL, and is reported by one news account to be a $16M project that involved an unstated, but apparently substantial, amount of EB-5 investments.   It is only because of the crusading TV news team at WPBF, the ABC affiliate in Palm Beach, that the workers got any money at all, a partial payment for their work on the shrimp farm, according to the station's report.   Florida Organic Aquaculture's excuse for not paying the workers sounds a little like a 'the dog ate my home-work' response.   Its CEO, Cliff Morris, told the station that an unnamed 'foreign investor in the Middle East had tried to wire transfer a large sum, but that the investor's country blocked the transfer'..."

Koch, the libertarian chairman and CEO of Koch Industries, Inc. -- wrote an op-ed piece decrying the suppression of free speech taking place at universities across America.     You have to salute their good intentions.   But as well-intentioned and accurate as their critique is, the Bloomberg-Koch column is largely useless.     Why?   Because they assiduously avoid identifying who or what acts are causing our universities to mimic fascist institutions, namely: ruining dissenters' careers; penalizing dissenting students; not hiring dissenting professors; disinviting the few invited speakers with whom the majority differs; shouting down dissenting speakers; students and faculty occupying and taking over college administrators' offices, etc.   The Bloomberg-Koch column is like going to your doctor and getting back a fully accurate report that you are dying that doesn't even hint at why you are dying.   Why don't Bloomberg and Koch mention the words 'left' or 'regressive'...even once?   The entire deterioration of the American university (and high school and elementary school) is the result of leftist influence.   How could they not mention this?...     The left is destroying the foundational values of this country, including, but hardly limited to, free speech.   In 2013, the Los Angeles Times actually announced that it would not publish certain letters to the editor -- presumably no matter how pre-eminent the scientist who wrote the letter is -- that challenge the anthropocentric global-warming-will-lead-to-worldwide-destruction hypothesis.   Likewise, the science and technology magazine 'Popular Science' announced it would not even allow such opinions in the comments section on its website except in certain cases...     Our colleges have been ruined, free speech is increasingly suppressed, the economy is stagnant, the federal debt is doubling and young Americans no longer see America as exceptional in any way, all because of the left..."

"Twice in recent days I've blogged about a remarkable Department of Justice (DoJ) manuscript documenting the foundation and work of DoJ's Office of Special Investigations (OSI) -- see here and here.   DoJ buried the manuscript for several years under cover of confidentiality, and finally released a redacted version only to have the unexpurgated document leaked to the New York Times...   It provides lessons that reverberate for civil servants generally about the importance of honest organizational self-analysis; and for government officials involved in immigration and citizenship matters particularly, given the applicability of OSI's experience in those matters in ways that still resonate in today's troubled world.   There is one last important lesson I'd like to share that comes in the section detailing the case history of 'Johann Breyer-An American Persecutor'.   Breyer's personal history is convoluted beyond belief because of where he and his parents were born, and where they resided at various points in their respective lives.   Breyer entered the United States after WW2, and ultimately naturalized.   OSI initiated a case against him when his war actions were discovered, but in the end the litigation to strip Breyer of his naturalization failed because he was found, via a circuitous, detailed, and legally technical path, to have derived USA citizenship at birth via his mother, even though neither he nor the government was aware of that until the denaturalization lawsuit brought the facts to light.   In the end, after many twists and turns through the federal courts, Breyer did not lose his citizenship — although the focus became an examination of his conduct in the context of expatriation, not denaturalization as one might have expected, because of the last-minute finding that he was a derivative citizen.   This is because even though he had taken an oath of naturalization, it was done through ignorance of his derivative citizenship.   Only an individual who gains citizenship by naturalization can be denaturalized, and thus be cast back into the status of an alien in the United States, which in turn subjects that individual to the possibility of deportation...   all citizens (natural born, derivative, or even naturalized) may be deemed to have expatriated if they engage in certain conduct..."

"A who's who list of 104 conservative movement leaders, organizations, and lawyers have sent House Oversight & Government Reform committee chairman Jason Chaffetz a letter and Memorandum of Cause for Hearings on Schedule B Violations (pdf).   The letter and Memorandum of Cause allege and describe serious violations and evasions of the Internal Revenue Code by California attorney-general Kamala Harris and New York attorney-general Eric Schneiderman with regard to the confidentiality of donor names and addresses on Schedule B of Form 990 filed by nonprofit organizations with the IRS.   Harris and Schneiderman are using state charitable solicitation licensing schemes to collect Schedule B donor names and addresses in dragnet fashion, even though their state laws do not require them to acquire that confidential federal tax return information.   They are demanding and collecting this information by choice, and in ways not authorized by the federal tax code.   The tax code and IRS interpretations place severe restrictions on state officials’ acquiring and using such information.   The letter, which was initiated by [participants of] the 'Weyrich Lunch', also asks chairman Chaffetz for congressional investigation into why the IRS has been derelict in failing to act to prevent the state AGs' violations of the tax code.   The letter references the state AGs' violations of the constitutional protections of the right of private association as expressed in the 1958 landmark civil rights case NAACP v. Alabama...   Civil and even criminal penalties for willful violations may apply to violators of the [extortion] code's confidentiality laws..."

"At yesterday's senate immigration sub-committee hearing, Brandon Judd, head of the Border Patrol agents' union, decried the 'catch and release' policy imposed by the White House.   (His statement starts at 2:05:50.)   He estimated that some 80% of the illegal aliens that are apprehended are released into the USA.   The key lines from his statement (emphasis added):   'If you are an unaccompanied minor we will not only release you, but will escort you to your final destination.   If you are a family unit, we will release you.   If you claim credible fear [of persecution], we will release you.   If you are a single male and we do not physically see you cross the border and you claim that you have been in this country since 2014, we will release you.'   Some are let go with Notices to Appear [more honestly referred to as Notices to Disappear], a kind of summons, though the head of USAICE's immigration enforcement branch testified at the same hearing that something like half of aliens with such notices never show up to their hearings.   (Surprise!)   But what's most interesting is that final entry in Judd's litany.   It's based on this line from [Obummer's] 2014 November [memo outlining planned unconstitutional and illegal executive non-feasance (pdf)], which includes in its second priority of people to deport:   'aliens apprehended anywhere in the United States after unlawfully entering or re-entering the United States and who cannot establish to the satisfaction of an immigration officer that they have been physically present in the United States continuously since 2014 January 1.'   This is not only a de facto amnesty for any illegal alien in the interior who settled here on or before 2013 December 31, but when applied at the border (as it obviously is) amounts to an illegal-alien right of return.   Open borders, in deed."

"The most significant pillar of that support is the 75% of Republicans who strongly back Israel.   On the Democrat side, the situation is significantly less reassuring, but acceptable in light of the near-consensus support Israel enjoys from Republicans.   Democrats support Israel 43% to 29%...   According to Lake's report, the conference was organized by professor Will Ruger from Texas State University.   From his bibliography, it appears that Ruger, a veteran of the war in Afghanistan, supports a [non-interventionist] foreign policy.   Ruger invited academics and foreign policy practitioners from varied schools of foreign policy.   Many are identified with the realist foreign policy camp.   The realists posit that naked USA interests, rather than moral concerns, should inform USA foreign policy.   Among their ranks, realists span the spectrum from muscular interventionists to [non-interventionists] like Ruger.   On the interventionist extreme stands University of Chicago professor John Mearsheimer.   In the past Mearsheimer argued that the USA can never be powerful enough.   In his view, the USA should continuously seek to maximize its power while weakening its competitors and adversaries, even in the absence of a concrete threat to its international position.   Harvard professor Steve Walt, OTOH, believes that the USA needs only to gain sufficient power to deter other countries from attacking it, and then hunker down in fortress USA.   Ruger also invited 3 former senior officials in the [Obummer regime], none of whom agreed to participate.   One of them, Anne-Marie Slaughter, served as #3 in the State Department under presumptive Democrat presidential nominee Hillary Clinton.   Slaughter supports the [leftist] interventionist foreign policy line, and as such was a vocal advocate of the over-throw of long-time US ally Egyptian president Hosni Mubarak in 2011.   Led by Mearsheimer and Walt, the disparate band of experts that Ruger assembled share but one common position.   And to advance that position, they have advocated policies that stand in open contradiction of the very foreign policy doctrines on which they built their careers.   That common position is hatred of Israel.   All of them oppose the USA alliance with Israel, and to varying degrees, maintain the bigoted view that Jews who support Israel have undue and malign influence on USA foreign policy..."
